(b) Judgements of the Administrative Tribunal should be final.

Legal advice will also be given to the Secretary-General on the disposition of appeals, staff grievances and disciplinary matters and on the implementation of Judgements of the Administrative Tribunal and administrative decisions.

The United Kingdom would not favour the introduction of a system of appeals from Administrative Tribunal Judgements.

From a legal standpoint, it is undesirable to retain a system which makes the review of Administrative Tribunal Judgements dependent on the decisions taken by the Committee on Application for Review of Administrative Tribunal Judgements, which is not a jurisdictional body.

1. At its forty-first session, the Committee on Applications for Review of Administrative Tribunal Judgements, established under article 11 of the statute of the Administrative Tribunal, considered the following applications:

(b) Review of the headquarters survey methodology: Administrative Tribunal Judgements on the phasing out of the language factor in Rome and at Vienna.

They are of the view that judgements of the Tribunal should be final and without appeal.

The ombudsman could perhaps look into staff grievances even before they became a subject for the Administrative Tribunal, and follow up on Administrative Tribunal decisions.

In addition, the matters which were the subject of the Administrative Tribunal's judgements did not seem to be such as to justify involvement of the International Court of Justice.
وباﻹضافة الى ذلك، فإن المسائل التي هي محل أحكام المحكمة اﻹدارية لا تبدو من النوع الذي يبرر تدخل محكمة العدل الدولية.

That testified to the trust of Member States, who rejected the right to investigate the Tribunal's judgements by means of a review procedure.
وهذا ما يقيم الدليل على ثقة الدول الأعضاء في المحكمة الإدارية، إذ تخلت الدول الأعضاء عن ممارسة حقها الرقابي على أحكام المحكمة الإدارية من خلال الإجراء الذي كانت قد نقحت به المادة 11.
