1. The conduct of an organ or agent of an international organization in the performance of functions of that organ or agent shall be considered as an act of that organization under international law whatever position the organ or agent holds in respect of the organization.
1- يُعتبر تصرف جهاز أو وكيل تابع لمنظمة دولية في تأدية مهامه فعلاً صادراً عن تلك المنظمة بمقتضى القانون الدولي، أيّاً كان المركز الذي يشغله ذلك الجهاز أو الوكيل في المنظمة.

1. The conduct of an organ or agent of an international organization in the performance of functions of that organ or agent shall be considered as an act of that organization under international law whatever position the organ or agent holds in respect of the organization.
1- يُعتبر تصرف جهاز أو وكيل تابع لمنظمة دولية في تأدية مهامه فعلاً صادراً عن تلك المنظمة بمقتضى القانون الدولي، أياً كان المركز الذي يشغله ذلك الجهاز أو الوكيل في المنظمة.

This wording is intended to convey the need for a close link between the ultra vires conduct and the organ's or agent's functions.
ويقصد بهذه الصيغة التعبير عن الحاجة إلى إقامة صلة وثيقة بين التصرف المتجاوز لحدود السلطة ومهام الجهاز أو الوكيل.

The conduct of an organ or an agent of an international organization shall be considered an act of that organization under international law if the organ or agent acts in that capacity, even though the conduct exceeds the authority of that organ or agent or contravenes instructions.
يعتبر تصرف أي جهاز أو وكيل تابع لمنظمة دولية فعلاً صادراً عن تلك المنظمة، بموجب القانون الدولي، إذا تصرف الجهاز أو الوكيل بهذه الصفة، وذلك حتى إذا تجاوز التصرف حدود سلطته أو كان مخالفاً للتعليمات.

In this situation the problem arises whether a specific conduct of the seconded organ or agent is to be attributed to the receiving organization or to the seconding State or organization.
وفي هذه الحالة، تنشأ مشكلة ما إذا كان يجب إسناد تصرف محدد يصدر عن الجهاز أو الوكيل المعار إلى المنظمة المتلقية أو إلى الدولة أو المنظمة المعيرة.

In the presence of a manifest excess of authority, whether or not it affects the competence of the international organization, one cannot say that the organ or agent acted " in that capacity " .
ففي حالة تجاوز بيِّن للسلطة، سواء كان يمس اختصاص المنظمة أم لا، لا يمكن القول إن الجهاز أو الوكيل قد تصرف ' ' بتلك الصفة``.

1- يعتبر تصرف أي جهاز أو وكيل تابع للمنظمة الدولية في تأدية مهامه فعلاً صادراً عن تلك المنظمة بمقتضى القانون الدولي، بغض النظر عن مركز الجهاز أو الوكيل بالنسبة للمنظمة.

Thus paragraph 1 simply states " whatever position the organ or agent holds in respect of the organization " .
وبالتالي فإن الفقرة 1 تنص ببساطة على ما يلي: " بغض النظر عن مركز الجهاز أو الوكيل بالنسبة للمنظمة " .

While the wording only refers to the second case, the first case is also covered because an act exceeding the competence of the organization necessarily exceeds the organ's or agent's authority.
وفي حين أن الصيغة المستخدمة لا تشير إلا إلى الحالة الثانية، فإن الحالة الأولى مشمولة أيضاً لأن الفعل الذي يتجاوز اختصاص المنظمة يتجاوز بالضرورة سلطة الجهاز أو الوكيل.

(9) Practice of international organizations confirms that ultra vires conduct of an organ or agent is attributable to the organization when that conduct is linked with the organ's or agent's official functions.
9 - وتؤكد ممارسة المنظمات الدولية أنّ التصرف الذي يتجاوز حدود السلطة والصادر عن جهاز أو وكيل يمكن إسناده إلى المنظمة عندما تكون لذلك التصرف صلة بوظائف الجهاز أو الوكيل الرسمية.

As was indicated in the commentary on article 6, this conclusion is implied, " because an act exceeding the competence of the organization necessarily exceeds the organ's or agent's authority " .
وكما أشير إليه في شرح المادة 6، فإن هذا الاستنتاج وارد ضمنا، ' ' لأن العمل المتجاوز لاختصاص المنظمة يتجاوز بالضرورة سلطة الجهاز أو الوكيل``().

In this situation the problem arises whether a specific conduct of the lent organ or agent is to be attributed to the receiving organization or to the lending State or organization.
وفي هذه الحالة، تنشأ مشكلة ما إذا كان يجب إسناد تصرف محدد يصدر عن الجهاز أو الوكيل المعار إلى المنظمة المتلقية أو إلى الدولة أو المنظمة المعيرة.

(7) The requirement in paragraph 1 that the organ or agent acts " in the performance of functions of that organ or agent " is intended to make it clear that conduct is attributable to the international organization when the organ or agent exercises functions that have been given to that organ or agent, and at any event is not attributable when the organ or agent acts in a private capacity.
7 - والهدف من الشرط الوارد في الفقرة 1 بأن يكون الجهاز أو الوكيل يتصرف " في تأدية مهام ذلك الجهاز أو ذلك الوكيل " هو توضيح أن التصرف يمكن إسناده إلى المنظمة الدولية عندما يمارس الجهاز أو الوكيل وظائف عهد بها إليه، ولا يمكن بأي حال من الأحوال إسناده إليها عندما يتصرف الجهاز أو الوكيل بصفته الشخصية.
