The National Ministry of Justice issued a compatibility certificate to the constitution of the state of Eastern Equatorial; the other nine southern state constitutions were sent back to the states legislative assemblies to consider some observations regarding the compatibility of the Interim National Constitution and the southern Sudan constitution.

(c) the Interim National Constitution has been adopted by the former National Assembly and the National Liberation Council of the Sudan People's Liberation Movement and ratified by the President of the Republic;
(ج) اعتماد الدستور القومي الانتقالي من جانب المجلس الوطني السابق ومجلس التحرير الوطني التابع للحركة الشعبية لتحرير السودان وتصديق رئيس الجمهورية عليه؛

(c) The proposals contravened the Interim National Constitution and the generally accepted principles of democracy. For instance, it was proposed that members should be appointed to the elected National Parliament, in alternation with the elected members.
(ج) مخالفة الدستور القومي الانتقالي ومخالفة الأسس الديمقراطية المتعارف عليها مثل مقترح تعيين نواب في المجلس الوطني المنتخب وإحلالهم عن طريق التناوب محل الأعضاء المنتخبين.

In spite of this fact, the state of emergency is usually considered as the last resort and there are limitations to the exercise of such power according to articles (210-211-212) of the Interim National Constitution 2005 which reads:
وعلى الرغم من هذا الواقع الذي يعيشه فإن حالة الطوارئ ينظر إليها عادة كملاذ أخير، وهناك قيود تحكم ممارسة هذه الصلاحية وفقاً للمواد (210-211-212) من الدستور القومي الانتقالي لعام 2005 الذي ينص على ما يلي:

نشر وتوزيع مواد (000 5 نسخة من كتيبات وملصقات) على المسؤولين الحكوميين السودانيين، وأعضاء الهيئة القضائية، ومنظمات المجتمع المدني بشأن الجوانب المتصلة بحقوق الإنسان في اتفاق السلام الشامل والفصل الخاص بوثيقة الحقوق في الدستور القومي الانتقالي ودستور جنوب السودان ودساتير الولايات

The application of the death penalty for minors under 18 years of age was expressly prohibited by the Interim Constitution, which provided for exceptions in cases of premeditated murder or crimes punishable by death under the sharia (hudud).
30- وقال، فيما يتعلق بتطبيق حكم الإعدام على قصّر دون سن 18 عاماً، إن الدستور القومي الانتقالي يحظر ذلك بوضوح بيد أنه ينص، أيضاً، على بعض الاستثناءات في حال القتل العمد أو في حال ارتكاب جرائم يعاقب عليها بالإعدام بموجب الشريعة (حدود).

As stipulated in article 5 of the Interim Constitution, the source of legislation in the states of northern Sudan was Islamic law (sharia), whereas that was not the case in the states of the south, hence certain differences between provisions in the national Interim Constitution and in the Interim Constitution of Southern Sudan with regard to the application of the death penalty for minors under 18 years of age.
وتنص المادة 5 من الدستور القومي الانتقالي على أن الشـريعة الإسلامية مصدر للتشـريعات في ولايات شمال السودان؛ ولكن الوضع مختلف في ولايات جنوب السودان، وهذا ما أدى إلى وجود بعض الفوارق بين الدستور القومي الانتقالي والدستور الانتقالي لجنوب السودان في الأحكام التي تضبط تطبيق عقوبة الإعدام على القصّر دون 18 عاماً من العمر.
