5.7 Three members of the Human Rights Committee went further and stated in Y.L. v. Canada that the Covenant did not apply to the dispute of the soldier, for two reasons.

6.5 The Committee takes note of the State party's argument that the Covenant does not apply rationae materiae because it concluded, after its ratification of the Covenant, the 1994 treaty with the Russian Federation regarding Estonian residence permits for former Russian military pensioners.

11. The Committee deplores the State party's refusal to report on the occupied territories and the State party's position that the Covenant does not apply to " areas that are not subject to its sovereign territory and jurisdiction " .

The Committee regrets that the State party continues to maintain the position that the Covenant does not apply with respect to individuals under its jurisdiction, but outside its territory, despite the interpretation to the contrary of article 2, paragraph 1, supported by the Committee's established jurisprudence, the jurisprudence of the International Court of Justice and State practice.

(38) Although this territory was not included in the State party's report (and the State party apparently considers that, owing to an absence of population, the Covenant does not apply to this territory), the Committee takes note of the State party's acceptance that its prohibition of the return of Ilois who had left or been removed from the territory was unlawful.

The Committee expressed its concern in this regard, to which Israel replied in a further report of 19 October 2001 that it has " consistently maintained that the Covenant does not apply to areas that are not subject to its sovereign territory and jurisdiction " (a formula inspired by the language of the International Covenant on Civil and Political Rights).
