22. In paragraph 12 of its resolution 1564 (2004), the Security Council asked me to establish an international commission of inquiry immediately to investigate reports of violations of international humanitarian law and human rights law in Darfur by all parties.
22 - وفي الفقرة 12 من القرار 1564 (2004)، طلب إليَّ مجلس الأمن أن أقوم على وجه السرعة بإنشاء لجنة تحقيق دولية تضطلع بالتحقيق في التقارير المتعلقة بانتهاكات القانون الإنساني الدولي وقانون حقوق الإنسان التي ترتكبها جميع الأطراف في دارفور.

As provided for in that resolution, the investigations will be guided by the following aims: (a) to investigate reports of violations of international humanitarian law and human rights law by all parties; (b) to determine whether or not acts of genocide have occurred; (c) to identify the perpetrators of such violations with a view to ensuring that those responsible are held accountable.

In September 2004 the Security Council requested that the Secretary-General rapidly establish an international commission of inquiry to investigate reports of violations of international humanitarian law and human rights law in Darfur by all parties, to determine also whether or not acts of genocide had occurred and to identify the perpetrators of such violations with a view to ensuring that those responsible were held accountable.

3. In a submission to OHCHR, the Permanent Observer Mission of Palestine expressed dismay at the persistent lack of cooperation by Israel with the international fact-finding mission on the incident of the humanitarian flotilla, and demanded that the Government of Israel conduct independent, impartial, thorough, effective and prompt investigations into the allegations of violations of international humanitarian law and human rights law.
3- وقد أعربت بعثة المراقب الدائم لفلسطين، في رسالة موجهة إلى المفوضة السامية، عن جزعها إزاء الامتناع المستمر لإسرائيل عن التعاون مع البعثة الدولية لتقصي الحقائق في حادثة أسطول الإغاثة الإنسانية، وطالبت بأن تُجري حكومة إسرائيل تحقيقات مستقلة ونزيهة وشاملة وفعالة وعاجلة في المزاعم المتعلقة بانتهاكات القانون الإنساني الدولي والقانون الدولي لحقوق الإنسان.

In paragraph 2 of its report (see S/2005/60), the Commission set out the tasks it had been set by the Security Council in resolution 1564 (2004), namely to investigate reports of violations of international humanitarian law and human rights by all parties, to determine also whether or not acts of genocide have occurred, and to identify the perpetrators of such violations, with a view to ensuring that those responsible are held accountable.
