This follows the spirit of article 13 (1) of ILO Convention No. 169, which emphasizes respect for the cultural and spiritual values of indigenous peoples in relation to their lands and territories, and article 26 (3) of the Declaration, which underscores that the recognition of indigenous land rights must respect " the customs, traditions and land tenure systems of the indigenous peoples concerned " .
وهذا يتبع روح المادة 13 (1) من اتفاقية منظمة العمل الدولية رقم 169 التي تؤكد على احترام القيم الثقافية والروحية للشعوب الأصلية فيما يتصل بأراضيها وأقاليمها، وكذلك المادة 26(3) من إعلان الأمم المتحدة بشأن الشعوب الأصلية التي تؤكد على ضرورة أن يتم الاعتراف بحقوق الأراضي للشعوب الأصلية " مع مراعاة عادات الشعوب الأصلية المعنية وتقاليدها ونظمها الخاصة بحيازة الأراضي " .
