25. The identification of applicants from tribal groupings H41, H61 and J51/52 has been a constant source of contention between the parties and the subject of three recent compromise proposals.
٢٥ - وما برح تحديد هوية مقدمي الطلبات من المجموعات القبلية حاء ٤١ وحاء ٦١ وياء ٥١/٢٥ يشكل مصدرا مستمرا للخلاف بين الطرفين كما أنه كان موضوعا لثلاثة اقتراحات توفيقية في اﻵونة اﻷخيــرة.

5. The Government of Morocco has maintained the position that it will not participate in the identification of those applicants from tribal groupings H41, H61 and J51/52 who are listed in the 1974 Spanish census and their immediate families, until the overall issue of the identification of all applicants from those three groupings is resolved.
٥ - وتمسكت حكومة المغرب بموقفها من عدم الاشتراك في عملية تحديد هوية مقدمي الطلبات من المجموعات القبلية حاء-٤١، و حاء-٦١ و ياء-٥١/٥٢ المدرجين في التعداد اﻹسباني لعام ١٩٧٤ وأفراد أسرهم المباشرين إلى أن يتم التوصل إلى حل شامل لمسألة تحديد هوية جميع مقدمي الطلبات من هذه المجموعات الثلاث.

4. No proposals have been forthcoming from either party that would permit the resumption of identification of applicants from tribal groupings H41, H51 and J51/52.
٤ - ولم يقدم أي الطرفين مقترحات من شأنها أن تسمح باسئتناف تحديد هوية المتقدمين من المجموعات القبلية حاء ٤١ وحاء ٥١ وياء ٥١/٥٢.

5. In its discussion of the programme for May, the Frente POLISARIO asked MINURSO to include, in the Tindouf area and in Mauritania, the identification of those applicants from tribal groups H41, H61 and J51/52 who are listed in the 1974 census of the Territory and are therefore entitled, under the Houston agreements, to be convoked together with their immediate families.
٥ - ولدى مناقشة جبهة بوليساريو لبرنامج أيار/ مايو، طلبت الى البعثة أن تضمن نشاطها في منطقة تندوف وفي موريتانيا تحديــد هويــة المتقدميــن بالطلبات من المجموعات القبلية حاء - ٤١ وحاء - ٦١ وياء - ٥١/٥٢ المدرجين في تعداد عام ١٩٧٤ لﻹقليم ويحق لهم من ثم، بموجب اتفاقات هيوستن، أن يستدعوا مع أسرهم المباشرة.

The Assistant Secretary-General informed Council members that identification of the remaining 65,000 applicants from the tribal groupings H41, H61, J51/52 was continuing and was expected to be concluded by mid-December 1999.
وقام الأمين العام المساعد بإعلام أعضاء المجلس بأن تحديد هوية المتبقين من الذين تقدموا بطلبات وعددهم 000 65 من المجموعات القبلية H41 و H61 و J51/52 مستمر ومن المتوقع إنجازه بحلول منتصف كانون الأول/ديسمبر 1999.

By 1 December 1998, the date proposed for publishing the lists, the identification process will not be complete because the identification of the 65,000 applicants from tribal groupings H41, H61 and J51/52 will only begin on that date.

وسيسمح ذلك للمفوضية بالشروع فورا في اﻷعمال التحضيرية ﻹعادة اللاجئين إلى وطنهم وتحديد هوية مقدمي الطلبات من المجموعات القبلية H41 و H61 و J51/52، ولكي تبدأ عملية الطعون في ١ كانون اﻷول/ ديسمبر ١٩٩٨، وهو التاريخ المنصوص عليه لنشر القائمة المؤقتة للناخبين غير المنتمين إلى هذه المجموعات الثلاث.

14. The second round of the appeals process started when the second part of the provisional voter list, containing the names of individual applicants from tribal groupings H41, H61 and J51/52, was communicated by my Special Representative to the two parties on 17 January 2000.
14 - بدأت الجولة الثانية من عملية تقديم الطعون عندما أبلغ ممثلي الخاص الطرفين في 17 كانون الثاني/يناير 2000 بالجزء الثاني من قائمة الناخبين المؤقتة، التي تضم أسماء مقدمي الطلبات من المجموعات القبلية H41 و H61 و J51/52.

1. The parties agree that they will not directly or indirectly sponsor or present for identification anyone from tribal groupings H41, H61 and J51/52 other than persons included in the Spanish census of 1974 and their immediate family members, but the parties shall not be obligated to actively prevent individuals from such tribal groupings from presenting themselves.
١ - يتفق الطرفان على أنهما لن يرعيا أو يتقدما بصورة مباشرة أو غير مباشرة بأي شخص لتحديد هويته من المجموعات القبلية حاء - ٤١ وحاء - ٦١ وياء - ٥١/٥٢ عدا اﻷشخاص المدرجين في التعداد الاسباني لعام ١٩٧٤ وأفراد أسرهم المباشرين، ولكن الطرفان لن يكونا ملزمين بأن يمنعا بالفعل اﻷفراد من هذه المجموعات القبلية من التقدم بأنفسهم.

3. The measures to be taken were detailed in a set of documents, which include a draft protocol on the identification of those applicants from tribal groupings H41, H61 and J51/52 wishing to present themselves individually, a draft protocol on the appeals process, a memorandum on the activities of UNHCR in the region, and a calendar outlining the next stages of the Settlement Plan.
٣ - وقد وردت التدابير التي يلزم اتخاذها بالتفصيل في مجموعة من الوثائق تتضمن مشروع بروتوكول يتعلق بتحديد هوية مقدمي الطلبات من المجموعات القبلية حاء ٤١ وحاء ٦١ وياء ٥١/٥٢ الذين يرغبون في تقديم أنفسهم بصورة فردية، ومشروع بروتوكول يتعلق بعملية الطعون، ومذكرة بشأن أنشطة مفوضية اﻷمم المتحدة لشؤون اللاجئين في المنطقة وجدولا زمنيا يُحدد المراحل المقبلة لخطة التسوية.

In this regard, the memorandum questioned the simultaneous initiation of the identification of the remaining applicants from tribal groupings H41, H61 and J51/52 and the appeals process for applicants already identified, and voiced concerns about several aspects of the modalities for the identification of the three tribal groupings and the appeals procedures.
وفي هذا الصدد، تشككت المذكرة في مسألة الشروع في وقت واحد في تحديد هوية مقدمي الطلبــات المتبقيــن من المجموعات القبلية حاء ٤١ وحاء ٦١ وياء ١٥/٥٢ وعملية الطعون بالنسبة لمقدمي الطلبات الذين تم بالفعل تحديد هويتهم، وأعربت عن قلقها إزاء النواحي المتعددة لطرائق تحديد هوية المجموعات القبلية الثلاث وﻹجراءات الطعون.

9. It will be recalled that, under the Houston agreements the parties agreed that they would not directly or indirectly sponsor for identification anyone from tribal groupings H41, H61 and J51/52 other than persons included in the 1974 census and their immediate family members, but would not actively prevent individuals from such tribal groupings from presenting themselves.
٩ - وجدير بالذكر أن الطرفين، بموجب اتفاقات هيوستن اتفقا على أنهما لن يرعيا أو يتقدما بصورة مباشــرة أو غير مباشــرة بأي شخــص لتحديـــد هويتــه من المجموعات القبلية حاء - ٤١، وحاء - ٦١، وياء - ٥١/٥٢، عدا اﻷشخاص المدرجين في تعداد عام ١٩٧٤ وأفراد أسرهم المباشرين، إلا أنهما لن يقوما عمليا بمنع اﻷفراد من هذه المجموعات القبلية من التقدم بأنفسهم.

4. Further to these consultations and to his own contacts with the parties, I accepted my Special Envoy's recommendation to resume without delay identification of those applicants from tribal groupings H41, H61 and J51/52 who wish to present themselves individually, and at the same time to begin the appeals process, as the best means of moving forward in the implementation of the Settlement Plan.
٤ - وقد وافقتُ على التوصية التي قدمها مبعوثي الشخصي، بعد هذه المشاورات وبعد اتصالاته هو بالطرفين. وتقضي التوصية بالعودة دون تأخير إلى تحديد هوية أصحاب الطلبات من المجموعات القبلية حاء ٤١ وحاء ٦١ وياء ٥١/٥٢ الذين يرغبون في تقديم أنفسهم بصورة فردية، وبالشروع في الوقت نفسه في عملية الطعون، بوصفهما أفضل طريقة للتقدم في تنفيذ خطة التسوية.

وبهــذا الصـدد، شككت المذكــرة فـي عملية إجــراء تحديد هوية الباقين من مقدمي الطلبات من المجموعات القبلية حاء - ٤١ وحاء - ٦١ وياء ٥١/٥٢، في نفس وقت البدء في دراسة الطعون من مقدمي الطلبات الذين تحددت هوياتهم فعلا، وأعربت عن القلق إزاء عدة جوانب من طرق تحديد هويات المجموعات القبلية الثلاث وإجراءات الطعون.

8. In these letters, my Special Representative indicated that, without prejudice to subsequent decisions on any additional applicants from tribal groups H41, H61 and J51/52, completion of the identification of the above-mentioned 4,000 individuals remained the most appropriate approach to reaching a just solution, insofar as this would allow sufficient time working out proposals to deal with the complex issue of those " contested " groups.
٨ - ذكر ممثلي الخاص في هاتين الرسالتين أنه، دون المساس بقرارات لاحقة بشأن أي مقدمي طلبات إضافيين من المجموعات القبلية حاء - ٤١، وحاء - ٦١، وياء ٥١/٥٢، يظل إكمال تحديد هوية اﻷشخاص البالغ عددهم ٠٠٠ ٤، المذكورين أعلاه، يمثل أنسب نهج للتوصل إلى حل عادل، حيث أنه سوف يتيح وقتا كافيا ﻹعداد مقترحات لمعالجة المسألة المعقدة المتعلقة بهذه المجموعات " المطعون في أهليتها " .
