Taking " all appropriate measures, including legislation, to modify or abolish existing laws, regulations, customs and practices that constitute discrimination against persons with disabilities " (art. 4, para. 1 (b)) constitutes the main general obligation for all States parties.

The Special Rapporteur in the field of cultural rights stressed that cultural rights include the right not to participate in specific traditions, customs and practices, particularly those that infringe on human rights and dignity, and to revise and (re)negotiate existing traditions, values or practices, regardless of their provenance.

(a) The obligation to respect - States parties must: refrain from engaging in any act or practice that is inconsistent with the Convention; abolish or modify or abolish existing discriminatory laws, customs and practices; closely consult with and actively involve persons with disabilities in the development and implementation of legislation and policies to implement the Convention;

Accordingly, article 4, paragraph 1 (b), of the Convention obliges States parties to " take all appropriate measures, including legislation, to modify or abolish existing laws, regulations, customs and practices that constitute discrimination against persons with disabilities " .
