Before examining the present cases, the Working Group recalls that, according to the information available to it, between 1986 and 1994, certain Lebanese nationals were allegedly arrested in Lebanon, either by soldiers of the South Lebanese Army (SLA) or by troops of the Israeli Defense Forces (IDF) and eventually transferred to Israel, where, allegedly, some of them have been held in incommunicado detention for long periods of time.

In this regard, the Working Group notes that such restrictions would be legitimate in respect of material which is not then used as evidence against the accused at trial and is not of an exculpatory nature.

With respect to the second issue under consideration, the Working Group refers to the Human Rights Committee's general comment No. 13, which states that " quite often the reason for the establishment of such courts is to enable exceptional procedures to be applied which do not comply with normal standards of justice. "
16- وفيما يتعلق بالمسألة الثانية، يشير الفريق العامل إلى التعليق العام رقم 13 للجنة المعنية بحقوق الإنسان الذي جاء به أنه " غالباً ما يكون السبب في إنشاء هذه المحاكم هو التمكن من تطبيق إجراءات استثنائية لا تتفق مع المعايير العادية للعدالة " ().

In conclusion, the Working Group refers to the critical findings by United Nations human rights bodies of human rights violations occurring in the Islamic Republic of Iran, and adds to those cited above General Assembly resolution 65/226 on the situation of human rights in the Islamic Republic of Iran and Human Rights Council resolution 16/9 on the situation of human rights in the Islamic Republic of Iran.
38- وفي الختام، يشير الفريق العامل إلى الاستنتاجات النقدية التي توصّلت إليها هيئات معاهدات حقوق الإنسان التابعة للأمم المتحدة بشأن انتهاكات حقوق الإنسان في جمهورية إيران الإسلامية، ويضيف إلى ما ذكره منها أعلاه قرار الجمعية العامة 65/226 بشأن حالة حقوق الإنسان في جمهورية إيران الإسلامية وقرار مجلس حقوق الإنسان 16/9 عن حالة حقوق الإنسان في الجمهورية.

As to the question that the trial was conducted and the judgement pronounced in the absence of the persons charged, the Working Group points out that international instruments, inter alia, the International Covenant on Civil and Political Rights which Algeria ratified, require that persons charged are tried in their presence.

17. Furthermore, the Working Group points out that the obligation to provide adequate compensation under article 9, paragraph 5, of the International Covenant on Civil and Political Rights is based on the consideration that the three brothers have been the victims of arbitrary detention and that subsequent proceedings or findings concerning them cannot limit the State's responsibility.
