The onus of proving that there is a foreseeable, real and personal risk of being subjected to torture upon extradition or deportation rests on the applicant.

غير أنه إذا كانت شرعية دخول الأجنبي أو إقامته موضع نزاع، فان أي قرار بهذا الشأن يؤدي إلى طرده أو ترحيله ينبغي أن يتخذ وفقاً للمادة 13.

The question is whether it is necessary, in all the circumstances of the case, to expel or deport him in order to protect the society from his criminal propensity or whether this object can be achieved by taking a lesser action than expulsion or deportation.
والسؤال هو هل من الضروري، في جميع ملابسات هذه القضية، طرده أو ترحيله لحماية المجتمع من نزعته اﻹجرامية، أم أنه يمكن بلوغ هذا الهدف بإجراء أقل من الطرد أو الترحيل.

What distinguishes deportation or expulsion from the practice of renditions, however, is that they have a basis in national law and are preceded by an administrative process resulting in a decision which is notified to the person to be expelled or deported and can be challenged before a court. This opportunity to challenge the removal from the territory of the State is essential to uphold the principle of nonrefoulement.
غير أن ما يميز الترحيل أو الطرد عن عمليات الإعادة هو الأساس الذي تقوم عليه في القانون الوطني والعملية الإدارية التي تسبقها والتي تفضي إلى قرار يخطر به الشخص المزمع طرده أو ترحيله ويمكن الطعن فيه أمام محكمة وإمكانية الطعن في الطرد من أراضي الدولة أساسية لاحترام مبدأ عدم الطرد.

The State party attached the Danish Refugee Board Decision of 10 November 2005 in which it was decided that although the author may be deported from Denmark, he cannot be forcibly returned to Uganda or deported to another country in which he is not protected against being set back to Uganda, pursuant to section 31 of the Aliens Act.
أرفقت الدولة الطرف القرار الصادر عن المجلس الدانمركي للاجئين في 10 تشرين الثاني/نوفمبر 2005 الذي ينص على أنه رغم احتمال ترحيل صاحب البلاغ من الدانمرك، فإنه لا يمكن إعادته قسراً إلى أوغندا أو ترحيله إلى بلد آخر لا يكون فيه في مأمن من الإعادة إلى أوغندا، وفقاً للفقرة 31 من قانون الأجانب.

The Committee also urges the State party to ensure that no Palestinian refugee children fleeing the Syrian Arab Republic are prevented from entering Jordan or deported back to the Syrian Arab Republic and that they receive the same treatment as Syrian children in the State party.
كما تحث اللجنة الدولة الطرف على ضمان عدم منع أي طفل لاجئ فلسطيني فارّ من الجمهورية العربية السورية من دخول الأردن أو ترحيله ليعود إلى الجمهورية العربية السورية، وعلى ضمان أن يعامل هؤلاء الأطفال أسوةً بالأطفال السوريين في الدولة الطرف.

9.5 The Committee recalls its general comment No.1 on the implementation of article 3, which states that the Committee must assess whether there are substantial grounds for believing that the complainant would be in danger of being subjected to torture were he/she to be expelled, returned or extradited to the country of origin.
9-5 وتشير اللجنة إلى تعليقها العام رقم 1 بشأن تنفيذ المادة 3()، الذي جاء فيه أنه يجب على اللجنة تقدير ما إذا كانت هناك أسباب حقيقية تدعو إلى الاعتقاد بأن صاحب الشكوى سيتعرض لخطر التعذيب في حالة طرده أو إعادته أو ترحيله إلى بلده الأصلي.

15. Please provide information on the authorities responsible for determining whether or not a person is to be expelled, removed or returned to another country and explain what criteria are used to arrive at those decisions.
15- يُرجى تقديم معلومات عن السلطات التي تقرر طرد شخص أو ترحيله أو إعادته قسراً وتحديد المعايير التي تستند إليها في ذلك.

The Committee refers to its general comment on article 7 and recommends that Canada revise this policy in order to comply with the requirements of article 7 and to meet its obligation never to expel, extradite, deport or otherwise remove a person to a place where treatment or punishment that is contrary to article 7 is a substantial risk.
وتشير اللجنة إلى تعليقها العام على المادة 7 وتوصي بأن تراجع كندا هذه السياسة حتى تتفق مع اشتراطات المادة 7 وتواجه التزامها بعدم طرد أي شخص أو تسليمه أو ترحيله أو إبعاده بأي شكل كان إلى مكان يكون فيه خطر كبير من حدوث معاملة أو معاقبة تخالف المادة 7.
