" Contract particulars " means any information relating to the contract of carriage or to the goods (including terms, notations, signatures and endorsements) that is in a transport document or an electronic transport record.

وتساعد شروط الولاية القضائية الأجنبية المذكورة في مستند النقل أو سجل النقل الإلكتروني الطرف المعني على بدء إجراءات قانونية.

(a) A transport document or an electronic transport record is prima facie evidence of the carrier's receipt of the goods as stated in the contract particulars;
(أ) يعتبر مستند النقل أو سجل النقل الإلكتروني دليلا ظاهرا على تسلم الناقل البضاعة حسبما هو مبين في تفاصيل العقـد؛

1. The absence or inaccuracy of one or more of the contract particulars referred to in article 38, paragraphs 1 or 2, does not of itself affect the legal character or validity of the transport document or of the electronic transport record.
1- لا يمسُّ إغفال أو عدم صحة واحد أو أكثر من تفاصيـل العقـد المشـار إليها في الفقرتين 1 أو 2 من المادة ٣8، في حد ذاته، بالطابع القانوني لمستند النقل أو سجل النقل الإلكتروني أو بصحة أي منهما.
