I. FIRST ATTEMPT TO TRAVEL to Beit Hanoun 3 - 8 3

The Council's decision to dispatch the High-Level Mission to Beit Hanoun reflected its deep concern at the corroborated reports of the killing and injuring of civilians by the Israel Defense Forces (IDF).
وجاء قرار المجلس بإيفاد البعثة إلى بيت حانون إظهاراً لمشاعر القلق العميق الذي يساوره إزاء التقارير الموثّقة التي وردت عن سقوط قتلى وجرحى من المدنيين على أيدي قوات الدفاع الإسرائيلية.

At its third special session, in its resolution S-3/1, the Council decided to dispatch urgently a high-level fact-finding mission, to be appointed by the President of the Human Rights Council, to travel to Beit Hanoun.
وفي الدورة الاستثنائية الثالثة، قرر المجلس أن يوفد بصورة عاجلة إلى بيت حانون بعثة رفيعة المستوى لتقصي الحقائق، يعينها رئيس المجلس.

He welcomed the Council resolution on the human rights situation in the Occupied Palestinian Territory endorsing the recommendations of the high-level fact-finding mission on Beit Hanoun, which was delayed owing to the non-cooperation of Israel.
ورحّب بقرار المجلس بشأن حالة حقوق الإنسان في الأرض الفلسطينية المحتلة الذي أيد بعثة تقصي الحقائق رفيعة المستوى إلى بيت حانون والتي تأجلت بسبب عدم تعاون إسرائيل.

I. First attempt to travel to Beit Hanoun
أولاً - المحاولة الأولى للسفر إلى بيت حانون

13. The High-Level Mission has not been able to fulfil its mandate of travelling to Beit Hanoun.
13- ولم تتمكن البعثة من تنفيذ ولايتها بالسفر إلى بيت حانون.

The present report is the final report of the mission, following its trip to Beit Hanoun in May 2008.
وهذا التقرير هو التقرير النهائي للبعثة عقب سفرها إلى بيت حانون في أيار/مايو 2008.

3. On three occasions, the mission attempted to travel to Beit Hanoun via Israel.
3- حاولت البعثة، في ثلاث مناسبات، السفر إلى بيت حانون عبر إسرائيل.

In view of the unchanging attitude of the Government of Israel, the mission decided in January 2008 to travel to Beit Hanoun via Egypt.
ونظراً لموقف الحكومة الإسرائيلية الذي لم يتغير، قررت البعثة في كانون الثاني/يناير 2008 السفر إلى بيت حانون عبر مصر.

4. The mission travelled to Beit Hanoun from 27 to 29 May 2008.
4- وسافرت البعثة إلى بيت حانون في الفترة من 27 إلى 29 أيار/مايو 2008.

At its third special session, in its resolution S-3/1 of 15 November 2006, the Council decided to dispatch urgently a high-level fact-finding mission, to be appointed by the President of the Council, to travel to Beit Hanoun.
وفي الدورة الاستثنائية الثالثة، قرر المجلس، في قراره دإ-3/1 المؤرخ 15 تشرين الثاني/نوفمبر 2006، أن يوفد بصورة عاجلة إلى بيت حانون بعثة رفيعة المستوى لتقصي الحقائق يعيِّنها رئيس المجلس.

وقرر المجلس، في قراره دإ-3/1 المؤرخ 15 تشرين الثاني/نوفمبر 2006، أن يوفد بصورة عاجلة إلى بيت حانون بعثة رفيعة المستوى لتقصي الحقائق يعينها رئيس المجلس.

8. The mission wishes to underline the importance of its travelling to Beit Hanoun to witness first-hand the situation of victims and survivors of the shelling, in particular to comprehend the deep distress of the victims of the shelling and of the population generated by the ongoing blockade.
8- وتود البعثة تأكيد أهمية سفرها إلى بيت حانون لتشهد مباشرة حالة الضحايا والناجين من عمليات القصف، وعلى وجه الخصوص لتدرك المحنة القاسية التي يعيشها ضحايا القصف والسكان من جراء الحصار المستمر.

19. From 27 to 28 May 2008, the high-level fact-finding mission to Beit Hanoun established under Human Rights Council resolution S-3/1 led by Archbishop Desmond Tutu, visited the Gaza Strip, entering through Rafah.
19 - وفي الفترة من 27 إلى 28 أيار/مايو 2008، قامت بعثة تقصى الحقائق الرفيعة المستوى إلى بيت حانون المنشأة بموجب قرار المجلس S-3/1، برئاسة رئيس الأساقفة ديزموند توتو، بزيارة قطاع غزة عبر ممر رفح.

13. The Rapid Response Unit also supported the implementation of resolutions and decisions of the Human Rights Council, such as the dispatch of the High-Level Fact-Finding Mission to Beit Hanoun in May 2008.
13 -كما كفلت وحدة الاستجابة السريعة دعم تنفيذ قرارات مجلس حقوق الإنسان ومقرراته، مثل إيفاد بعثة تقصي الحقائق الرفيعة المستوى إلى بيت حانون في أيار/مايو 2008.

I am writing to inform you of developments in implementing Human Rights Council resolution S-3/1, under which you appointed me to lead the High-Level Fact-Finding Mission to Beit Hanoun in the Palestinian territory of Gaza.
أكتب إليكم لأطلعكم على التطورات المتعلقة بتنفيذ قرار مجلس حقوق الإنسان دإ-3/1 الذي قمتم بتعييني بموجبه لرئاسة بعثة تقصي الحقائق الرفيعة المستوى إلى بيت حانون في قطاع غزة الفلسطيني.

In the light of the fact that the core mandate of the Mission was " to travel to Beit Hanoun " , I regret to inform you that the Mission is unable to fulfil its mandate and will not be able to present a report to the Human Rights Council as requested.
ونظراً لأن جوهر ولاية البعثة كان " السفر إلى بيت حانون " ، يؤسفني أن أعلمكم بأن البعثة لا تستطيع الوفاء بولايتها ولن تتمكن من تقديم تقرير إلى مجلس حقوق الإنسان كما طلب منها.

5. Once it became clear, in December 2006, that the High-Level Mission would not be permitted to travel to Beit Hanoun via Israel, the High-Level Mission considered the most appropriate means of giving effect to the mandate given to it by the Council.
5- وحالما اتضح في كانون الأول/ديسمبر 2006 أنه لن يُسمح للبعثة بالسفر إلى بيت حانون عن طريق إسرائيل، نظرت البعثة في أنسب السُبل لتنفيذ الولاية التي أناطها المجلس بها.

(f) Support to the fact-finding missions established by the Human Rights Council (for example, High-level fact-finding mission on Beit Hanoun in the occupied Palestinian territories, and the Commission of Inquiry on Lebanon);
