87. According to article 3 of the Hague Convention IV of 1907 and to article 91 of Protocol I of 1977, a State violating an international obligation may be liable to pay compensation.
٨٧ - ووفقا للمادة ٣ من اتفاقية لاهاي الرابعة لعام ١٩٠٧ والمادة ٩١ من البروتوكول اﻷول لعام ١٩٧٧، يجوز طلب تعويضات من الدولة التي تنتهك التزاما دوليا.

88. Some violations of article 53 of the Fourth Geneva Convention of 1949 are listed as grave breaches in article 147 of that Convention and thus constitute war crimes, as is violation of article 23 of the Hague Convention IV.
٨٨ - وقد أدرجت بعض انتهاكات المادة ٥٣ من اتفاقية جنيف الرابعة لعام ١٩٤٩ في المادة ١٤٧ منها، بوصفها انتهاكات خطيرة، وهي تشكل، بذلك، جرائم حرب، تماما مثل انتهاك المادة ٢٣ من اتفاقية لاهاي الرابعة.

As the Court noted, customary law concerning the conduct of military operations derives mainly from the annex to the Hague Convention IV of 18 October 1907 respecting the Laws and Customs of War on Land.
فالقانون العرفي المتعلق بسلوك العمليات الحربية مستمد معظمه، كما أوضحت المحكمة، من مرفق اتفاقية لاهاي الرابعة المؤرخة ١٨ تشرين اﻷول/أكتوبر ١٩٠٧ بشأن قوانين الحرب البرية وأعرافها.

Article 46 of the Hague Convention IV of 1907 requires that " family honour and rights " be respected.
والمادة ٦٤ من اتفاقية لاهاي الرابعة لعام ٧٠٩١ تقتضي احترام " شرف العائلة وحقوقها " .

The Hague Convention (IV) requires any combatant " to be commanded by a person " .
وتقتضي اتفاقية لاهاي (الرابعة) أن يكون هناك على رأس أي مقاتلين " شخص مسؤول عن مرؤوسيه " .

These rules originated in articles 23 (g), 25 and 27 of the annex to the Hague Convention IV. They were the subject of new formulations in the draft convention on the rules of aerial warfare of 1923 and in the resolution adopted by the General Assembly of the League of Nations on 30 September 1938.
ويرجع منشأ هذه القواعد إلى المواد ٢٣ )ز( و ٢٥ و ٢٧ من مرفق اتفاقية لاهاي الرابعة. وقد كانت موضوع صياغات جديدة في مشروع الاتفاقية المتعلقة بتنظيم الحرب الجوية المعقودة في عام ١٩٢٣ وفي القرار الذي اتخذته الجمعية العامة لعصبة اﻷمم في ٣٠ أيلول/سبتمبر ١٩٣٨.

Article 23 (c) of the [regulations annexed to the] Hague Convention IV of 1907 provides that: " [sic] To attack and destroy civilian localities is prohibited ... " [sic].
فقد نصت المادة 23 الفقرة (ج) من اتفاقية لاهاي الرابعة لعام 1907 على " تحريم مهاجمة وتدمير المواقع المدنية ... " .

The Hague Convention (IV) Respecting the Laws and Customs of War on Land deals with the question of sexual assaults in article 46: " Family honour and rights, the lives of persons and private property, as well as religious convictions and practice, must be respected. "
وتتناول اتفاقية لاهاي )الرابعة( المتعلقة بقوانين وأعراف الحرب البرية مسألة الاعتداءات الجنسية في المادة ٤٦: " يجب احترام شرف اﻷسرة وحقوقها، وحياة اﻷشخاص، والممتلكات الخاصة، فضلا عن المعتقدات والممارسات الدينية " .

The so called “Martens clause” is included in the preambular part of the Hague Convention No. IV of 18 October 1907 concerning the Laws and Customs of War on Land.

89. As regards international humanitarian law, the Court would first note that Israel is not a party to the Fourth Hague Convention of 1907, to which the Hague Regulations are annexed.
