وعملاً بالمادة 2 من العهد، تتعهد الدولة الطرف بضمان تمتع جميع الأفراد الموجودين داخل إقليمها أو الخاضعين لولايتها بالحقوق المعترف بها في العهد وبسبيل فعال للتظلم في حال ثبوت حصول انتهاك لتلك الحقوق.

II. Promotion of the rule of law at the international level 4. At the international level, the rule of law accords predictability and legitimacy to the actions of States, strengthens their sovereign equality and underpins the responsibility of a State to all individuals within its territory and subject to its jurisdiction.
4 - تكفل سيادة القانون على الصعيد الدولي قابلية التنبؤ بأعمال الدول وتضفي عليها طابع الشرعية وتعزز تساوي الدول في السيادة وتدعم مسؤولية الدولة إزاء جميع الأفراد الموجودين داخل إقليمها والخاضعين لولايتها.

10. Pursuant to article 2 of the Covenant, the State party has undertaken to ensure to all individuals within its territory and subject to its jurisdiction the rights recognized in the Covenant, the Committee wishes to receive from the State party, within 180 days, information about the measures taken to give effect to its Views.
10- وعملاً بأحكام المادة 2 من العهد، تعهدت الدولة الطرف بأن تكفل لجميع الأفراد الموجودين داخل إقليمها والخاضعين لولايتها الحقوق المعترف بها في العهد، وترغب اللجنة في تلقي معلومات من الدولة الطرف، في غضون 180 يوماً، عن التدابير المتخذة لوضع آرائها موضع التنفيذ.

In this regard, the obligations deriving from article 2.1 are also relevant, since a State party is required under that article to ensure that the rights protected under the Covenant are available to all individuals within its territory and subject to its jurisdiction, except rights which are expressly made to apply to citizens, for example, political rights under article 25.
والالتزامات الناجمة عن المادة 2(1) هي ذات صلة أيضاً في هذا الصدد، حيث إنه يلزم بموجب تلك المادة أن تكفل الدولة الطرف أن تكون الحقوق المصونة بموجب العهد متاحة لجميع الأفراد الموجودين داخل إقليمها والخاضعين لولايتها، فيما عدا الحقوق المنصوص صراحة على أنها تنطبق على المواطنين، ومن ذلك على سبيل المثال الحقوق السياسية المكفولة بموجب المادة 25.

63. In accordance with general comment No. 23 of the Human Rights Committee on the rights of minorities (article 27 of the Covenant), the Special Rapporteur recalls that even when individuals are not citizens of the State where they live or happen to be, " a State party is required [...] to ensure that the rights protected under the Covenant are available to all individuals within its territory and subject to its jurisdiction " (para. 5.1).
63- ووفقاً للتعليق العام رقم 23 للجنة المعنية بحقوق الإنسان بشأن حقوق الأقليات (المادة 27 من العهد الدولي)، يذكّر المقرر الخاص بأنه " يلزم [...] أن تكفل الدولة الطرف أن تكون الحقوق المصونة بموجب العهد متاحة لجميع الأفراد الموجودين داخل إقليمها والخاضعين لولايتها " (الفقرة 5-1) حتى عندما لا يكون هؤلاء الأفراد من مواطني الدولة التي يقيمون أو يجدون أنفسهم فيها.
