The author recalls that the Committee has declared that the Ordinance seems to promote impunity and infringe the right to an effective remedy.

Furthermore, the absence of the legal right to undertake judicial proceedings following the promulgation of Ordinance No. 06-01 implementing the Charter for Peace and National Reconciliation continues to deprive Rachid Sassene, as well as the author and her family, of any access to an effective remedy, since the Ordinance prohibits the initiation of legal proceedings to shed light on the most serious of crimes, including enforced disappearance.
ثم إن استحالة اللجوء إلى هيئة قضائية بعد صدور الأمر رقم 06-01 المتعلق بتنفيذ ميثاق السلم والمصالحة الوطنية، لا تزال تحرم رشيد ساسين وصاحبة البلاغ وأسرتها من إمكانية ممارسة سبيل انتصاف فعال، ذلك أن الأمر المذكور يمنع من اللجوء إلى العدالة لكشف ملابسات أكثر الجرائم خطورة، مثل حالات الاختفاء القسري().

(a) the Ordinance, adopted by the National Assembly, amends and supplements Ordinance No. 96.22 of 9 July 1996 concerning the suppression of offences against the regulations on currency and capital movements into and out of the country, mentioned previously in the national report submitted by Algeria pursuant to Security Council resolution 1390 (2002).
أ - يعدِّل الأمر المذكور الذي أقرته الجمعية الشعبية الوطنية ويكمِّل الأمر رقم 96-22 المؤرخ 9 تموز/يوليه 1996 المتعلق بقمع انتهاك أنظمة الصرف ونقل رؤوس الأموال من وإلى الخارج الذي سبقت الإشارة إليه في التقرير الوطني الذي قدمته الجزائر عملا بقرار مجلس الأمن 1390 (2002).

10. the Ordinance applies directly to the case; accordingly, the conclusion that there has been a violation of article 2.2 in the Djebrouni case is neither abstract nor merely of academic interest: finally, it should not be overlooked that the violations found have a direct impact on any reparation which the Committee might determine when it decides each individual case.
10- وتنطبق أحكام الأمر المذكور في الحالة قيد البحث انطباقاً مباشراً، وبالتالي فإن استنتاج انتهاك الفقرة 2 من المادة 2 في قضية جبروني ليست مسألة مجردة ولا مجرد أمر ذي أهمية نظرية فحسب. وفي الأخير، ينبغي ألا ننسى أن الانتهاكات التي تثبتها اللجنة لها أثر مباشر على التعويضات التي يتعين عليها أن تحددها عند البت في كل بلاغ.

Furthermore, the absence of the legal right to undertake judicial proceedings since the promulgation of Ordinance No. 06-01 implementing the Charter for Peace and National Reconciliation continues to deprive Yahia Kroumi, the author and his family of access to an effective remedy, because the Ordinance prohibits, on pain of imprisonment, the initiation of legal proceedings to shed light on the most serious crimes, such as enforced disappearances.
زد على ذلك أن استحالة اللجوء إلى هيئة قضائية بعد صدور الأمر رقم 06-01 المتعلِّق بتنفيذ ميثاق السلم والمصالحة الوطنية، لا تزال تحرم يحيى كرومي وصاحب البلاغ وأسرته من إمكانية ممارسة سبيل انتصاف فعَّال، لأن الأمر المذكور يمنع من اللجوء إلى العدالة لكشف ملابسات أكثر الجرائم خطورةً، مثل حالات الاختفاء القسري().

The framework established by the Order imposes undue restrictions on the right of Palestinians to freedoms of assembly, opinion and expression.
ويفرض الإطار الذي يقره الأمر المذكور قيوداً لا موجب لها على حق الفلسطينيين في حريات التجمّع والرأي والتعبير.

JS2 considered that the Order was a first step towards recognition of the practice regularly resorted to by the authorities of secretly detaining individuals suspected of offences against State security.
وجاء في هذه الورقة أن الأمر المذكور يشكل خطوة أولى نحو الإقرار بممارسة منتظمة استخدمتها السلطات تتمثل في احتجاز أشخاص متهمين بالمساس بأمن الدولة في أماكن سرية.

67. The objectives of the Committee are set out in article 3 of the Order.

Section 12 of the said order does not apply to the freezing of assets of persons and organizations not appearing on the list issued by the Security Council.
ولا ينطبق البند 12 من الأمر المذكور على تجميد أصول الأشخاص والمنظمات غير المدرجة في القائمة التي أصدرها مجلس الأمن.

A decree was adopted to implement the provisions of the above-mentioned Order which provides for practical internal security arrangements for port and airport buildings and areas.
وصدر مرسوم لتنفيذ أحكام الأمر المذكور ينص على الأساليب العملية للأمن الداخلي للمؤسسات والموانئ والمطارات.
