الحد اﻷدنى لسن الاشتراك في اﻷعمال الحربية

To explain the difference between the terms and understand why it is participation in hostilities that must be prohibited, we must first of all define what an armed conflict is.
ولتوضيح هذه الفروق توضيحا أفضل، يتعين تعريف ما هو النزاع المسلح من أجل فهم السبب في كون منعه ينطبق فعلا على الاشتراك في اﻷعمال الحربية.

This should apply both to participation in hostilities, whether direct or indirect, as it is impossible to distinguish between the two in practice, and to entry into the armed forces, whether voluntary or compulsory, as a way of preventing participation in hostilities and because of the nature of the work, which is inherently dangerous.
وذلك، سواء فيما يتعلق بالاشتراك في اﻷعمال الحربية، المباشر منها وغير المباشر، نظراً لكونه يتعذّر التمييز بينهما، أو بالالتحاق بالقوات المسلحة، سواء بصفة طوعية أو اجبارية، كوسيلة لمنع الاشتراك في اﻷعمال الحربية وبسبب نوع هذا العمل، الذي هو خطير في حد ذاته.

Furthermore, if Governments are willing to accept a prohibition on the use in hostilities of under 18-year-olds, such volunteers should be treated as trainees, otherwise the governmental commitment to and ability to prevent their involvement in hostilities is open to doubt.

Children should not be forced to take part in hostilities under any circumstances.

(c) Disaggregated data (for example, by gender, age, region, rural/urban areas and social and ethnic origin, time spent in the armed groups, and time spent participating in hostilities) on children who have been recruited and used in hostilities by armed groups and on those who have been arrested by the State party;

70. Raising the age for participation in hostilities from 15 to 18 years would bring a number of advantages for the children concerned.
٠٧- وينطوي رفع الحد اﻷدنى لسن الاشتراك في اﻷعمال الحربية من الخامسة عشرة إلى الثامنة عشرة على مزايا عدة بالنسبة إلى اﻷطفال المعنيين.

81. The fact is that the reference to “direct participation” considerably weakens the protection conferred on children, because it is not participation in hostilities in general which is covered but just a certain type of participation.
١٨- وبالفعل تضعف عبارة " الاشتراك المباشر " كثيراً حماية الطفل. فالمقصود هنا ليس الاشتراك في اﻷعمال الحربية بمفهومه الشامل بل نوع محدد من الاشتراك فيها فقط.

93. From these definitions, it is evident that it is “participation in hostilities” which must be prohibited, without any intention to signify thereby in non-legal terms that children may participate in armed conflicts.
٣٩- يستخلص من هذه التعاريف أن " الاشتراك في اﻷعمال الحربية " هو الذي يجب أن يحظر دون أن يعني ذلك، من الناحية غير القانونية، أنه يمكن للطفل الاشتراك في المنازعات المسلحة.

UNHCR and UNICEF strongly support the adoption of a proposed optional protocol to the Convention on the Rights of the Child on involvement of children in armed conflict, raising the minimum age of any kind of recruitment into armed forces or armed groups and for any kind of participation in hostilities to 18 years.
وتؤيد المفوضية واليونيسيف بشدة اعتماد البروتوكول المقترح وهو البروتوكول الاختياري الملحق باتفاقية حقوق الطفل بشأن اشتراك اﻷطفال في المنازعات المسلحة، وهو يرفع السن اﻷدنى بالنسبة ﻷي نوع من أنواع التجنيد في القوات المسلحة أو الجماعات المسلحة وﻷي نوع من الاشتراك في اﻷعمال الحربية إلى سن اﻟ ١٨.

Australia would also prefer that the prohibition on participation in hostilities take the widest possible form, by deletion of the word “direct”, so as to encompass the possibility that children who do not take a direct role but who are nonetheless inevitably caught up in conflict are protected by the protocol.
وتفضل استراليا أيضا أن يتخذ منع الاشتراك في اﻷعمال الحربية أوسع صيغة ممكنة بحذف عبارة " اشتراكاً مباشراً " ، بحيث تشمل المادة إمكانية حماية البروتوكول لﻷطفال الذين لا يقومون بدور مباشر ومع ذلك لا يكون هناك مفر من وقوعهم في شرك النزاع.

72. The remarks relating to the tendency of the international community to fix the age of majority at 18 years are equally relevant to the issue of participation in hostilities.
٢٧- وعلاوة على هذا، تنطبق الملاحظات التي أبديت سلفاً بخصوص ميل المجتمع الدولي إلى تحديد الثامنة عشرة سناً للرشد على الاشتراك في اﻷعمال الحربية)٦١(.

85. Taking the existing texts into account, and to avoid any risk of confusion as to the interpretation of the provisions of the optional protocol, it is participation in “hostilities” and not in “armed conflicts” that must be specified.
٥٨- مراعاة للنصوص القائمة بالفعل وتفاديا لكل لبس في تفسير أحكام البروتوكول الاختياري المقبل، لا بد من اﻹشارة إلى منع الاشتراك في " اﻷعمال الحربية " وليس في " المنازعات المسلحة " .

86. In international humanitarian law, there are numerous references to the concept of “participation in hostilities”, or to “direct participation in hostilities” but not to that of “participation in armed conflicts”.
٦٨- ففي القانون الدولي اﻹنساني، يشار عدة مرات إلى مفهوم " الاشتراك في اﻷعمال الحربية " أو " الاشتراك المباشر في اﻷعمال الحربية " ، ولا يشار إلى مفهوم " الاشتراك في المنازعات المسلحة " )٩٢(.

6. In connection with the issue of direct and indirect involvement, UNHCR has considerable field experience in conflict situations and holds the position that children need protection from involvement in hostilities of both a direct and an indirect nature.
٦- وفيما يتعلق بقضية الاشتراك المباشر وغير المباشر، فإن لدى المفوضية خبرة ميدانية كبيرة في حالات النزاع وموقفها قوامه أنه لا بد من حماية اﻷطفال من الاشتراك في اﻷعمال الحربية ذي الطابع المباشر وغير المباشر على السواء.

We support the wording for draft article 1, with the deletion of “17” and “a direct”, so that it would read: “States parties shall take all feasible measures to ensure that persons who have not attained the age of 18 years do not take part in hostilities.” The protection from involvement in hostilities is the fundamental purpose of the draft optional protocol.
نؤيد صياغة مشروع المادة ١ مع حذف " السابعة عشرة " و " اشتراكاً مباشراً " بحيث تصبح الجملة كما يلي: " تتخذ الدول اﻷطراف جميع التدابير الممكنة عملياً لضمان عدم اشتراك اﻷشخاص الذين لم يبلغوا الثامنة عشرة من عمرهم في اﻷعمال الحربية " . فالحماية من الاشتراك في اﻷعمال الحربية هي الغرض اﻷساسي من مشروع البروتوكول الاختياري.

" 1. Children who have not attained the age of 18 years shall not [be allowed to] take part in hostilities.
" ١- لا يجوز ]السماح[ لﻷطفال الذين لم يبلغوا الثامنة عشرة، من عمرهم ]ﺑ[ الاشتراك في اﻷعمال الحربية.

Aux termes de l’article 4, paragraphe 1 du PA II, sont protégées à l’égard de ces actes «toutes les personnes qui ne participent pas directement ou ne participent plus aux hostilités, qu’elles soient ou non privées de liberté».
وحسب المادة ٤ )١( من البروتوكول اﻹضافي الثاني فإن اﻷشخاص المحميين من هذه اﻷعمال هم جميع أولئك " الذين لا يشتركون بصورة مباشرة أو الذين يكفون عن الاشتراك في اﻷعمال الحربية - سواء قيدت حريتهم أم لم تقيد " .
