The provisions of the present Protocol shall not affect the obligations of States Parties to the four Geneva Conventions of 12 August 1949 and the Additional Protocols thereto of 8 June 1977, nor the opportunity available to any State Party to authorize the International Committee of the Red Cross to visit places of detention in situations not covered by international humanitarian law.
لا تمس أحكام هذا البروتوكول التزامات الدول الأطراف باتفاقيات جنيف الأربع المؤرخة 12 آب/أغسطس 1949 وبروتوكوليها الإضافيين المؤرخين 8 حزيران/يونيه 1997، ولا تمس إمكانية أن تأذن أي دولة طرف للجنة الصليب الأحمر الدولية بزيارة أماكن الاحتجاز في الحالات غير المشمولة بالقانون الإنساني الدولي.

3. With regard to situations not covered by international humanitarian law, ICRC proposed in its statement of 19 March 1999 (see the annex to this document) that the convention should include a reference to the statutes of the International Red Cross and Red Crescent Movement.
٣ - وفيما يخص الحالات غير المشمولة بالقانون اﻹنساني الدولي اقترحت لجنة الصليب اﻷحمر الدولية في بيانها الصادر يوم ١٩ آذار/ مارس ١٩٩٩ )انظر مرفق هذه الوثيقة( بأن تتم اﻹشارة في نص الاتقاقية إلى النظام اﻷساسي لحركة الصليب اﻷحمر والهلال اﻷحمر الدولية.

2. In cases not covered by the present Convention or by other international agreements, the personnel of the United Nations force and associated civilian personnel remain under the protection of universally recognized principles of international law, in particular norms of international humanitarian law.
٢ - في الحالات غير المشمولة بهذه الاتفاقية أو بأي اتفاقات دولية أخرى، يظل أفراد قوات اﻷمم المتحدة والموظفون المدنيون المرتبطون بها يتمتعون بالحماية التي تكفلها مبادئ القانون الدولي المعترف بها عالميا، ولا سيما قواعد القانون اﻹنساني الدولي.

Reaffirming that in cases not covered by this Convention or by other international agreements, civilians and combatants remain under the protection and authority of the principles of international law, derived from established custom, from the principles of humanity and from the dictates of public conscience,
وإذ تؤكد من جديد أنه في الحالات غير المشمولة بهذه الاتفاقية أو باتفاقات دولية أخرى، يظل المدنيون والمحاربون مشمولين بحماية وسلطة مبادئ القانون الدولي، المنبثقة عن العرف المستقر وعن مبادئ الإنسانية وإملاءات الضمير العام،

(iii) in cases not covered by paragraphs (i) or (ii) of this article, the carriage on deck is in accordance with the contract of carriage, or complies with the customs, usages, and practices of the trade, or follows from other usages or practices in the trade in question.
`3` في الحالات غير المشمولة بالفقرتين `1` و`2` من هذه المادة، إذا كان النقل على سطح السفينة يتوافق مع عقد النقل أو يراعي العادات والأعراف والممارسات الجارية في المهنة، أو يتبع أعرافا أو ممارسات أخرى في المهنة المعنية.

23. One Respondent State identified the two ways in which the principle of humanity can be understood: first as the foundation upon which IHL was developed; and secondly, as an additional principle which must guide the decisions and actions of military forces in cases not covered by rules of customary or treaty law.
23- وحددت دولة مجيبة الكيفيتين اللتين يمكن بهما فهم مبدأ الإنسانية: أولاهما فهمه كأساس لوضع أحكام القانون الإنساني الدولي؛ وثانيتهما كمبدأ إضافي يجب أن يوجه القرارات والإجراءات التي تتخذها القوات العسكرية في الحالات غير المشمولة بقواعد القانون العرفي أو قانون المعاهدات.

77. The Martens clause 8/ states that in cases not covered by specific provisions, civilians and combatants remain under the protection and authority of the principles of international law derived from established customs, from the principles of humanity and from the dictates of public conscience.
٧٧ - ينص شرط " مارتينز " )٨( على أنه في الحالات غير المشمولة بأحكام محددة، يظل اﻷشخاص المدنيون والمحاربون تحت حماية وسلطة مبادئ القانون الدولي المستمدة من اﻷعراف القائمة، ومن مبادئ اﻹنسانية، ومن كل ما يمليه الضمير العام.
