CERD recommended effectively consulting the communities that might be affected by development projects or the exploitation of natural resources, with a view to obtaining their free, prior and informed consent.

62. In accordance with the United Nations Declaration on the Rights of Indigenous Peoples and ILO Convention No. 169, States have a duty to consult with indigenous peoples through special, differentiated procedures in matters affecting them, with the objective of obtaining their free, prior and informed consent.

The State party should adopt measures to effectively protect sacred areas of indigenous peoples against desecration, contamination and destruction and ensure that consultations are held with the indigenous communities that might be adversely affected by the State party's development projects and exploitation of natural resources with a view to obtaining their free, prior and informed consent for proposed project activities.
ينبغي أن تعتمد الدولة الطرف تدابير لتحمي بصورة فعالة مناطق السكان الأصليين المقدسة من التدنيس والتلوث والتخريب، وأن تكفل عقد مشاورات مع المجتمعات المحلية الأصلية التي يمكن أن تتأثر سلباً بأنشطة الدولة الطرف في إطار المشاريع الإنمائية واستغلال الموارد الطبيعية بغية الحصول على موافقتها الحرة والمسبقة والمستنيرة على أنشطة المشاريع المقترحة.

(a) Ensure that effective consultations are carried out at each stage of the process with communities likely to be affected by projects to develop and exploit natural resources, with the aim of obtaining their free, prior and informed consent, particularly in the case of mining projects.
(أ) أن تضمن في كل مرحلة من مراحل عملية استغلال الموارد إجراء مشاورات فعالة مع المجتمعات المحلية التي قد تتضرر من مشاريع التنمية واستغلال الموارد الطبيعية، بهدف الحصول على موافقتها الحرة والمسبقة والمستنيرة، ولا سيما في حالات التعدين.

States should establish mechanisms, including monitoring, to ensure that indigenous peoples' traditional knowledge is not expropriated without the free, prior and informed consent of indigenous peoples and provision is made for appropriate access and benefit-sharing arrangements.
20- وينبغي أن تنشئ الدول آليات تشمل آليات للرصد، لئلا تُستحل المعارف التقليدية للشعوب الأصلية دون الحصول على موافقتها الحرة والمسبقة والمستنيرة، ولكي تنص أحكامها على الترتيبات التي تتيح الوصول إلى هذه المعارف وتقاسم منافعها على النحو المناسب.
