In this respect, the provisions of the Law on Mass Events are aimed at creating conditions for the realization of citizens' constitutional rights and freedoms and the protection of public safety and public order during the holding of such events on streets, squares and other public locations.
وفي هذا الصدد، ترمي أحكام القانون المتعلق بالتظاهرات الجماهيرية إلى تهيئة ظروف إعمال حقوق المواطنين الدستورية وحرياتهم وحماية السلامة العامة والنظام العام أثناء عقد هذه التظاهرات في الشوارع والحدائق وغيرها من المرافق العامة.

Presently, the order of organizing and holding assemblies, gatherings, street marches, demonstrations and pickets is regulated by the Law on Mass Events of 7 August 2003.
وحالياً، يحكم القانون المتعلق بالتظاهرات الجماهيرية المؤرخ 7 آب/أغسطس 2003 أمر تنظيم التجمعات والتظاهرات والمسيرات والمظاهرات والإضرابات.

9. The Republic of Belarus adopted the Law on Mass Events on 20 December 1997; in so doing, it committed a violation of the Covenant, regardless of whether the Law was applied.
9- واعتمدت جمهورية بيلاروس القانون المتعلق بالتظاهرات الجماهيرية في 20 كانون الأول/ديسمبر 1997؛ وهي بذلك، قد انتهكت العهد، سواءً طبقت هذا القانون أو لم تطبقه.

Subsequently, the author submitted a claim to the Committee because the Law on Mass Events was applied against her; the Committee should have indicated in its Views that not only had the State party violated article 19, but also that the adoption of that Law violated article 2, paragraph 2, of the Covenant.
وفي وقت لاحق، قدمت صاحبة البلاغ شكوى إلى اللجنة بسبب تطبيق القانون المتعلق بالتظاهرات الجماهيرية ضدها؛ وكان ينبغي للجنة أن تبين في آرائها أن الدولة الطرف لم تكتف بانتهاك المادة 19، بل إنها انتهكت الفقرة 2 من المادة 2 من العهد باعتماد ذلك القانون.

10. The Law on Mass Events was applied directly to the case; accordingly, the conclusion that there has been a violation of article 2, paragraph 2 in the Tulzhenkova case is neither abstract nor merely of academic interest.
10- وقد طُبِّق القانون المتعلق بالتظاهرات الجماهيرية تطبيقا مباشرا في هذه القضية؛ وعليه، فإن استنتاج وجود انتهاك للفقرة 2 من المادة 2 في قضية تولزهينكوفا لا يعد مسألة مجردة ولا نظرية.

The State party had argued that the provisions of the Law on Mass Events were aimed at creating conditions for the realization of citizens' constitutional rights and freedoms and the protection of public safety and public order during the holding of such events on streets, squares and at other public locations.
وقد تذرّعت الدولة الطرف بأن أحكام القانون المتعلق بالتظاهرات الجماهيرية ترمي إلى تهيئة ظروف إعمال الحقوق والحريات الدستورية للمواطنين وحماية السلامة العامة والنظام العام أثناء تنظيم هذه التظاهرات في الشوارع والساحات وغيرها من المرافق العامة.

5.1 On 9 November 2009, the author notes that the State party has erroneously referred to article 8 of the Federal Law on Mass Events.
5-1 في 9 تشرين الثاني/نوفمبر 2009، لاحظ صاحب البلاغ أن الدولة الطرف أشارت خطأ إلى المادة 8 من القانون الاتحادي المتعلق بالتظاهرات الجماهيرية.

It further reiterates that the author's claim under article 21 of the Covenant is unfounded and that similar restrictions on the enjoyment of the right to peaceful assembly, as set out in that article, are also provided for in article 55 of the Constitution and in article 8 of the Federal Law on Mass Events.
وكررت الدولة الطرف قولها إن دعوى صاحب البلاغ بموجب المادة 21 من العهد لا أساس لها وإن قيوداً مماثلة بشأن التمتع بالحق في التجمع السلمي، كما هي واردة في هذه المادة، منصوص عليها أيضاً في المادة 55 من الدستور والمادة 8 من القانون الاتحادي المتعلق بالتظاهرات الجماهيرية.

Subsequently, the author submitted a claim to the Committee because the Law on Mass Events was applied against her; the Committee should have indicated in its Views that not only had the State party violated article 19, but also that the adoption of that Law violated article 2, paragraph 2, of the Covenant.
وعليه، قدمت صاحبة البلاغ شكوى إلى اللجنة بسبب تطبيق القانون المتعلق بالتظاهرات الجماهيرية ضدها؛ وكان ينبغي للجنة أن تبين في آرائها أن الدولة الطرف لم تكتف بانتهاك المادة 19، بل إنها انتهكت الفقرة 2 من المادة 2 من العهد باعتماد ذلك القانون.

However, the organization of demonstrations is restricted by the law " on Mass Events " , amended in 2003 to allow the repression of unauthorized private meetings, and by the Code of Administrative Offences.
إلا أن تنظيم المظاهرات يخضع للقيود المنصوص عليها في القانون " المتعلق بالتظاهرات الجماهيرية " ، الذي تم تعديله في عام 2003 للسماح بقمع الاجتماعات الخاصة غير المرخصة، وفي القانون المتعلق بالجرائم الإدارية.

The author submits that the organization of mass events is regulated by the Law on Mass Events in the Republic of Belarus (hereinafter Law on Mass Events).
