٦٢ - وأضاف أن الوفد البرازيلي لا يشاطر غيره شكوكهم في انطباق مشاريع المواد على اﻷنشطة التي لا يحظرها القانون الدولي والتي تسبب في الواقع أضرارا كبيرة عابرة للحدود حتى إن لم تنطو في الوقت ذي الصلة على خطر إلحاق تلك اﻷضرار.

Commentary (1) Article 1 limits the scope of the articles to activities not prohibited by international law and which involve a risk of causing significant transboundary harm through their physical consequences.
)١( يقتصر نطاق تطبيق المواد بموجب المادة ١ على اﻷنشطة التي لا يحظرها القانون الدولي والتي تنطوي على مخاطر إيقاع ضرر جسيم، عابر للحدود عن طريق النتائج المادية المترتبة عليها.

(3) The first criterion refers back to the title of the topic, namely that the articles apply to " activities not prohibited by international law " , whether such a prohibition arises in relation to the conduct of the activity or by reason of its prohibited effects.
)٣( المعيار اﻷول يشير إلى عنوان الموضوع نفسه، أي أن المواد تنطبق على " اﻷنشطة التي لا يحظرها القانون الدولي " سواء كان الحظر ناشئا عن النشاط نفسه أو عن نتائجه المحظورة.

In conclusion, while there was no question of giving up such an important enterprise, the Commission should not err on the side of over-ambition but should make further efforts to elaborate a convention which, while it would not be a panacea, would provide a reasonable means of limiting damage and providing equitable compensation to the victims of activities not prohibited by international law.
٥٦ - وأخيرا إذا كان اﻷمر يعني أنه لا يجب التخلي عن هذه العملية الهامة جدا فإنه لا ينبغي للجنة القانون الدولي أن ترتكب خطأ الافراط في الطموح وأن تحاول بمزيد من الجهد صياغة اتفاقية تمنح وسائل معقولة للحد من اﻷضرار وتمنح تعويضا عادلا لضحايا اﻷنشطة التي لا يحظرها القانون الدولي، وهذا دون أن تدعي تحقيق الكمال.

16. As provided in article 1 (a), the scope of the present draft articles would apply to " activities not prohibited by international law which involve a risk of causing significant transboundary harm " .
٦١ - وفق ما نصت عليه المادة ١ )أ(، فإن نطاق مشاريع المواد قيد النظر يسري على " اﻷنشطة التي لا يحظرها القانون الدولي التي تنطوي على مخاطر إيقاع ضرر ملموس عابر للحدود " .
