The model provision is based on article 7, paragraph 1, of the UNCITRAL Model Law on Procurement of Goods, Construction and Services (hereinafter referred to as the " UNCITRAL Model Procurement Law " ).

In this regard, the Union notes that at its thirty-fourth session, the Consultative Committee urged its member States to take account of the United Nations Commission on International Trade Law (UNCITRAL) Model Law on Procurement of Goods, Construction and Services when reforming or enacting their legislation on procurement.

In that connection, it had decided to include those provisions in a global text on procurement, more specifically in the UNCITRAL Model Law on Procurement of Goods, Construction and Services, thereby providing a unique reference source for States wishing to rely on those provisions for the elaboration of their own laws.

In particular, as was noted in the report on the twenty-sixth session, the United States commended the Commission's completion at its plenary session of the UNCITRAL Model Law on Procurement of Goods.

It had also considered 12 other substantive items, including the progress reports of its working groups on arbitration, transport law, electronic commerce and security interests; the revision of its 1994 Model Law on Procurement of Goods, Construction and Services; practical means to enhance its coordination function; and training and technical assistance.

59. Referring to the Model Law on Procurement of Goods, Construction and Services, his delegation welcomed the adoption of a text with an expanded scope and a guide to enactment, whose usefulness was obvious.

3. His delegation welcomed the progress made by Working Group I (Procurement) in updating the UNCITRAL Model Law on Procurement of Goods, Construction and Services, which would help to introduce transparency and certainty into national laws.

Mr. MORÁN BOVIO (Chairman of the United Nations Commission on International Trade Law (UNCITRAL)), introducing the item, recalled that during its twenty-sixth session in 1993, the Commission had adopted the UNCITRAL Model Law on Procurement of Goods and Construction, whose formulation had been entrusted to the Working Group on the New International Economic Order.

The deliberations of the Commission on public procurement were based on a note by the Secretariat (A/CN.9/539) that set out current activities of other organizations in the area of public procurement and presented information on practical experience in the implementation of the UNCITRAL Model Law on Procurement of Goods, Construction and Services, since its adoption in 1994.
