وأشار إلى أن مشروع المادة 5 ينص على أنه في حالة المعاهدات التي ينطوي موضوعها ضمنيا على مواصلة العمل بها، كليا أو جزئيا، خلال النزاعات المسلحة، لا يؤثر وقوع نزاع مسلح في حد ذاته على نفاذها وأن المرفق يشتمل على قائمة إرشادية بفئات المعاهدات المشار إليها في مشروع المادة 5.

20. His delegation welcomed the establishment of the Working Group on the effects of armed conflicts on treaties and commended it for taking an approach that did not rely on the intention of the parties in order to ascertain whether a treaty was susceptible to termination or suspension in the event of an armed conflict, or on a list of categories of treaties presumed to continue in operation during such a conflict.
20 - وأعرب عن ترحيب وفده بإنشاء الفريق العامل المعني بآثار المنازعات المسلحة على المعاهدات وأثنى عليه لاتباعه نهجا لا يعتمد على نية الأطراف للتيقّن مما إذا كانت معاهدة ما معرضة للإنهاء أو التعليق في حالة نشوب نزاع مسلح، أو على قائمة بفئات المعاهدات المفترض استمرار نفاذها أثناء مثل هذا النزاع.
