)ﻫ( المادة ٩ - لا يجوز اعتقال أحد أو حجزه أو سجنه إلا في الحالات التي يقررها ووفقا للشكل الذي ينص عليه القانون؛ ولتنفيذ أمر معين، يجب أن يكون اﻷمر صادرا عن سلطة مختصة ويقدﱠم كتابة.

" Any citizen who is arrested or imprisoned or whose liberty is restricted in any way shall be treated in a manner conducive to the preservation of his human dignity. No physical or mental harm shall be inflicted on him, nor shall he be detained or imprisoned in places other than those which are subject to the legal provisions governing prisons.
" كل مواطن يقبض عليه أو يحبس أو تقيد حريته بأي قيد تجب معاملته بما يحفظ عليه كرامة الإنسان ولا يجوز إيذاؤه بدنياً أو معنوياً، كما لا يجوز حجزه أو حبسه في غير الأماكن الخاضعة للقوانين الصادرة بتنظيم السجون.

No person may be arrested, searched, detained or imprisoned except within the framework of the law, and no person may be subjected to torture or degrading treatment. "
ولا يجوز القبض على أحد أو تفتيشه أو حجزه أو حبسه إلا وفق أحكام القانون، ولا يعرض أي إنسان للتعذيب أو المعاملة الحاطة بالكرامة " .

67. In respect of the right to security of person and protection against any harm, article 18 of the Basic Law provides that " personal freedom is guaranteed in accordance with the law. No person may be arrested, searched, detained or imprisoned, or have his residence or movement curtailed, except in accordance with the provisions of the law. "
67- وفي مجال أمن المواطن على شخصه وحمايته من أي أذى، نصت المادة 18 من النظام الأساسي للدولة على أن " الحرية الشخصية مكفولة وفقاً للقانون، ولا يجوز القبض على إنسان أو تفتيشه أو حجزه أو حبسه أو تحديد إقامته أو تقييد حريته في الإقامة أو التنقل إلا وفق أحكام القانون " .

76. Under article 42, " Any citizen who is arrested or detained or whose freedom is restricted in any way shall be treated in a manner consistent with his dignity as a human being. No physical or moral harm shall be inflicted upon him. He may be detained or imprisoned only in a place subject to the laws regulating places of detention.
76- نصت المادة 42 من الدستور على أن " كل مواطـن يقبض عليه أو يحبس أو تقيد حريته بأي قيد تجب معاملته بما يحفظ عليه كرامة الإنسان، ولا يجوز إيذاؤه بدنياً أو معنوياً، كما لا يجوز حجزه أو حبسه في غير الأماكن الخاضعة للقوانين الصادرة بتنظيم السجون.

Article 344 of the Federal Criminal Code fixes the penalty for a person who himself or through others illegally abducts, arrests, detains or otherwise deprives a person of his liberty. 58. At present there is no law regulating the situation in which a state of emergency is declared.
وتحدد المادة 344 من قانون العقوبات الاتحادي العقوبة التي يتم إنزالها على من خطف شخصا أو قبض عليه أو حجزه أو حرمه من حريته بأية وسيلة بغير وجه قانوني سواء أكان ذلك بنفسه أو بواسطة غيره.
