7.2 With regard to the author's contentions concerning a violation of article 9, since he was arrested without being informed of the reasons for his arrest, the Committee considers that, as the State party has not replied to these allegations, due weight must be given to them and it must be taken that the events occurred as the author described them.
7-2 وفيما يتعلق بحجج صاحب البلاغ بشأن انتهاك المادة 9، حيث إنه أوقف دون إبلاغه بأسباب توقيفه، تعتبر اللجنة أنه يجب إيلاء الأهمية الواجبة لهذه الادعاءات، ما دامت الدولة الطرف لم تردّ عليها، ويجب اعتبار أن الأحداث وقعت كما شرحها صاحب البلاغ.

8.6 With regard to the alleged violation of article 9, the Committee notes that, according to the author, on 26 November 2003, he was arrested without a warrant by soldiers of the Royal Nepalese Army and detained at the Chhauni military barracks incommunicado without being informed of the reasons for his arrest or the charges against him.
8-6 وفيما يتعلق بادعاء انتهاك المادة 9، تلاحظ اللجنة أن صاحب البلاغ يزعم أن جنوداً من الجيش الملكي النيبالي اعتقلوه في 26 تشرين الثاني/نوفمبر 2003، من دون مذكرة اعتقال واحتجزوه في ثكنة شوهني العسكرية منقطعاً عن العالم الخارجي دون إبلاغه بأسباب اعتقاله أو يعلموه بالتهم الموجهة إليه.
