The author submits that the right to present a constitutional motion is not effective in the circumstances of the present case, owing to the prohibitive cost of instituting proceedings in the High Court to obtain constitutional redress, the absence of legal aid for constitutional motions and the wellknown dearth of local lawyers willing to represent applicants free of charge.
ويفيد صاحب البلاغ أن الطعن بعدم الدستورية ليس متاحاً في الموضوع قيد البحث بسبب التكاليف الباهظة لإقامة الدعوى أمام المحكمة العليا من أجل الحصول على الانتصاف الدستوري، وبسبب عدم وجود مساعدة قضائية للطعن بعدم الدستورية والندرة المعروفة تماماً للمحامين الذين يوافقون على تمثيل المدعين بدون أتعاب.

In the present case, Mr. Ashby had been executed, and the Committee had been prevented from determining whether the State party had violated the provisions of the Covenant. Given those two facts, the Committee could justifiably conclude on the merits that Mr. Ashby had not had any remedy. It was precisely to avoid a situation of that sort that the Committee had adopted rule 86.
وقالت إن الدولة الطرف المعنية قد قامت في الموضوع قيد البحث بإعدام السيد أشبي ومنعت اللجنة من النظر في مدى انتهاكها لﻷحكام المنصوص عليها في العهد ولذلك فإنه يمكن القول من الناحية الموضوعية بأنها قد أخلّت بالتزامها بتوفير سبيل تظلم فعال للسيد أشبي، لا سيما وأن ما دعاها إلى اعتماد اﻷحكام التي وردت في المادة ٦٨ من نظامها الداخلي هو تجنب وقوع ما حدث.
