22. The Special Rapporteur urges the inclusion of the following elements in any new definition of a mercenary:

The failure to develop an appropriate definition of a mercenary or the adoption of piecemeal amendments to the current definition is likely to result in quite serious problems for the international community, including ones concerning security.

These new crimes are condemned by the international community and are punished by law; hence, the attempt to provide a flexible definition of a mercenary which includes any crime that the international community condemns or may condemn in the future.

The principle that should be adopted in elaborating the new legal definition of mercenary is that the State is not authorized to recruit and employ mercenaries.

He may thus appear to have the legal status of a national of the country where he becomes involved in an armed conflict, or where he will fulfil his criminal assignment, thereby avoiding the epithet of " mercenary " .

The conclusion therefore is that a mercenary is a criminal who, without prejudice to the punishment of those who recruited and paid him, must be severely punished, in accordance with the characterization of the offence under ordinary law, where national legislation contains no provision concerning the separate phenomenon of mercenary activity.

These ploys must be identified and situations in which it is presumed that attempts are being made to disguise the mercenary’s true status studied carefully.

In some cases, legal devices are used to conceal the nature of the assignment or to make the mercenary appear to be a national of the country in whose armed conflict he is involved.
