6. Not only does the Committee's statement that " it is not its task to weigh the evidence " conflict with general comment No. 1 and with its jurisprudence in individual communications; it also seems inconsistent with the Committee's decision in this very case.

1. In general, I agree with the Committee's decision in the Aboufaied v. Libya case (communication No. 1782/2008), but I regret to have to dissent from the contents of paragraph 7.12 of the Views and the conclusions drawn therefrom.
