The termination of or the withdrawal from a treaty, or the suspension of its operation, as a consequence of an armed conflict, shall not impair in any way the duty of any State to fulfil any obligation embodied in the treaty to which it would be subject under international law independently of that treaty.
لا يعفي إنهاء معاهدة أو الانسحاب منها أو تعليق نفاذها، بسبب نشوب نزاع مسلح، أي دولة على أي نحو من واجب الوفاء بأي التزام تتضمنه المعاهدة وتكون ملزمة به بموجب القانون الدولي بمعزل عن تلك المعاهدة.

2. The denunciation shall not in any way affect the duty of any State Party to fulfil any obligation embodied in this Agreement to which it would be subject under international law independently of this Agreement.
٢ - لا يؤثر الانسحاب، بأي شكل من اﻷشكال، على واجب أي دولة طرف في الوفاء بأي التزام يتضمنه هذا الاتفاق وتكون خاضعة له بمقتضى القانون الدولي بصرف النظر عن هذا الاتفاق.

2. The denunciation shall not in any way affect the duty of any State Party to fulfil any obligation embodied in this Agreement to which it would be subject under international law independently of this Agreement.
٢ - لا يؤثر الانسحاب بأي حال من اﻷحوال على واجب أي دولة طرف في الوفاء بأي التزام يتضمنه هذا الاتفاق، وتكون الدولة خاضعة له بمقتضى القانون الدولي بصرف النظر عن هذا الاتفاق.

3 - لا يؤثر النقض بأي حال من الأحوال على واجب أي دولة طرف في الوفاء بأي التزام تتضمنه هذه الاتفاقية، وتكون الدولة خاضعة له بمقتضى القانون الدولي بصرف النظر عن هذه الاتفاقية.

Draft article 9, which has its roots in article 43 of the 1969 Vienna Convention, provides that the termination of or the withdrawal from a treaty, or the suspension of its operation, as a consequence of an armed conflict, shall not impair in any way the duty of any State to fulfil any obligation embodied in the treaty to which it would be subject under international law independently of that treaty.
97 - ينص مشروع المادة 9، المقتبس من المادة 43 من اتفاقية قانون المعاهدات، على أن إنهاء معاهدة أو الانسحاب منها أو تعليق نفاذها، نتيجة لنزاع مسلح، لا يحد بأي حال من واجب أي دولة من واجب الوفاء بأي التزام تتضمنه المعاهدة وتكون ملزمة به بموجب القانـون الدولي بمعزل عن تلك المعاهدة.
