3. It is submitted that the above facts reveal violations by the State party of articles 6, 7, 9, paragraph 1, and 10, paragraph 1, of the Covenant.
٣ - تشير الشكوى الى أن الوقائع أعلاه تدل على انتهاك الدولة الطرف للمواد ٦ و ٧ و ٩، الفقرة ١، و ١٠، الفقرة ١، من العهد.

He maintains that the above facts violated his right to defence.
ويدفع بأن الوقائع المشار إليها أعلاه تنتهك حقه في الدفاع.

5.6 The author considers that the above facts constitute inhuman and degrading treatment of her and discrimination against her on the basis of her sex, in the sense of article 1 of the Convention.
5-6 ترى صاحبة البلاغ أن الحقائق المذكورة أعلاه تشكل معاملة لاإنسانية ومهينة لها وتمييزا ضدها على أساس نوع جنسها، حسب مدلول المادة 1 من الاتفاقية.

The author also claims that the above facts constitute a violation of his rights under article 9, paragraphs 1 and 3, of the Covenant.
كذلك يدّعي صاحب البلاغ أن الوقائع المذكورة أعلاه تشكل انتهاكاً لحقوقه بموجب الفقرتين 1 و3 من المادة 9 من العهد.

3.1 The author claims that the above facts constitute violations by the State party of his rights under articles 6, 7 and 15, of the Covenant.
3-1 يدعي صاحب البلاغ أن الوقائع المذكورة أعلاه تشكل انتهاكات من جانب الدولة الطرف لحقوقه المكفولة بموجب المواد 6 و7 و15 من العهد.

He maintains that he was refused a fair hearing because of the dependency and the partiality of the national courts and that the above facts violate his rights under article 14, paragraph 1, of the Covenant.
ويذهب إلى أنه قد حرم من حقه في محاكمة عادلة بسبب تبعية المحاكم الوطنية وتحيّزها وأن الوقائع المذكورة أعلاه تشكل انتهاكاً لحقه بموجب الفقرة 1 من المادة 14 من العهد.

3.1 The author claims that the above facts reveal violations of articles 7, 9, 12, 13, 17 and 23 of the Covenant.
٣-١ يدعي صاحب الشكوى أن الوقائع المذكورة أعلاه تكشف عن وجود انتهاكات للمواد ٧ و ٩ و ١٢ و ١٣ و ١٧ و ٢٣ من العهد.

3. The author contends that the above facts constitute violations by the State party of articles 6, 7, 9, and 10 of the Covenant.
3- يدعي صاحب البلاغ أن الوقائع المذكورة أعلاه تشكل انتهاكاً من الدولة الطرف للمواد 6 و7 و9 و10 من العهد.

On 26 April 2000, the author submitted an application to the European Court of Human Rights, in which she set out the above facts.
2-5 وفي 26 نيسان/أبريل 2000، قدمت صاحبة البلاغ طلباً إلى المحكمة الأوروبية لحقوق الإنسان، عرضت فيه الوقائع المذكورة أعلاه.

She also claimed that her husband and other family members were actively sought by the army in 2009, that the army had discovered that she had left the country and that based on the above facts they considered her to be a member of the Liberation Tigers of Tamil Eelam.
وادعت أيضاً أن الجيش كان يبحث بهمّة عن زوجها وعن أفراد آخرين من أسرتها في عام 2009 وأنه اكتشف أنها غادرت البلد وأن الوقائع أعلاه حملته على الاعتقاد بأنها عضو في نمور التاميل.

Based on the material before it, the Committee considers that the author has not shown sufficient grounds to support his argument that the above facts resulted in a violation of his rights under article 26 of the Covenant.
وفي ضوء المواد المعروضة على اللجنة، ترى اللجنة أن صاحب البلاغ لم يقدم الأسباب الكافية لإثبات ما يحتج به من أن الوقائع المشار إليها أعلاه أفضت إلى انتهاك لحقه بموجب المادة 26 من العهد.

We firmly believe it would be most appropriate for the Secretariat and/or the Security Council to investigate the above facts, among others, before accepting the said report as authoritative. Otherwise, this entire procedure will become a sham consumed in the service of unsatisfied political agendas.
إننا نعتقد بحزم أن سيكون من اﻷنسب لﻷمانة العامة و/أو مجلس اﻷمن التحري عن أمور شتى من بينها الحقائق المذكورة أعلاه قبل القبول بالتقرير المذكور بوصفه تقريرا موثوقا به، وإلا فإن اﻹجراء بأكمله سيصبح خدعة يجري استهلاكها لخدمة أهداف سياسية لم يتح تحقيقها.

Nonetheless, the above facts will be subjected to verification by the Kazakhstan authorities: in the near future a request for a medical examination of the author will be sent to the Office of the Prosecutor General of Kyrgyzstan.
ومع ذلك، ستقوم السلطات الكازاخستانية بالتحقق من الوقائع الآنفة الذكر: ففي المستقبل القريب سيرسل طلب إلى النيابة العامة في قيرغيزستان لإجراء فحص طبي لصاحب البلاغ.

3. The author claims that the above facts constitute a violation of her rights under article 19, paragraph 2, of the Covenant.
3- تدعي صاحبة البلاغ أن الوقائع السالفة الذكر تشكّل انتهاكاً لحقوقها المنصوص عليها في الفقرة 2 من المادة 19 من العهد.

3.8 Finally, the author contends that the above facts reveal also a violation of his son's rights under article 6 of the Covenant, as his death sentence was imposed on him after an unfair trial that did not meet the requirements of article 14.
3-8 وأخيراً، يدفع صاحب البلاغ بأن الوقائع المبيّنة أعلاه تكشف كذلك عن انتهاك حقوق ابنه بموجب المادة 6 من العهد، لأن عقوبة الإعدام أُصدرت بحقه في أعقاب محاكمة غير عادلة لم تف بمقتضيات المادة 14.

The author claims that his numerous complaints about the above facts remained unanswered.
ويدّعي صاحب البلاغ أنه لم يتلق رداً على شكاواه العديدة من الوقائع الواردة أعلاه.
