وفيمــا يتعلــق بمسألة ما إذا كان ينبغي اعتماد مشروع قرار ينطوي على إجراء تعديلات في الميثاق الحالي بالاستناد إلى المادة ١٨ أو المادة ١٠٨ من الميثاق، يرى وفــدي أن هذا يتوقف بدرجة كبيرة على النص الفعلي لمشــروع القرار الذي يتضمن التعديلات المقترحة.

تبلغ حكومة الدولة التي تترأس مؤتمر القمة، أو الدولة التي استضافت المؤتمر التأسيسي، أو الدولة التي يوجد على أراضيها مقر الوكالة، جميع اﻷعضاء وكذلك اﻷمين العام بأي تنقيح يُدخل على هذا الميثاق.

Article 12, paragraph 4, of the African Charter on Human and Peoples' Rights stipulates that: " A non-national legally admitted in a territory of a State Party to the present Charter, may only be expelled from it by virtue of a decision taken in accordance with the law. "
وتنص الفقرة 4 من المادة 12 من الميثاق الأفريقي لحقوق الإنسان والشعوب على أنه: ' ' لا يجوز طرد الأجنبي الذي دخل بصفة قانونية إلى أراضي دولة ما طرف فى هذا الميثاق إلا بقرار مطابق للقانون``.

Nothing contained in the present Charter shall authorize the United Nations to intervene in matters which are essentially within the domestic jurisdiction of any State or shall require the Members to submit such matters to settlement under the present Charter; but this principle shall not prejudice the application of enforcement measures under Chapter VII.
