وقد رُوي أن زوج صاحبة البلاغ لقي مصرعه بطلق ناري على يد رجال مقنعين، وذلك بعد مضي ثلاثة أشهر على تهديدات تلقتها الأسرة من شخصين أفادا بأن لديهما تعليمات من شرطة نيغومبو بقتله.

There was no evidence that the author's husband had abused the children, both of whom were fond of him and had no fear of him.
ولا يوجد أي دليل على أن زوج صاحبة البلاغ قد أساء معاملة الطفلين، وكلاهما يحبه ولا يساورهما أي خوف منه.

The State party recalls that the author's husband had been sentenced to 10 years and 6 months of imprisonment and prohibited from conducting economic activities for five years, by decision of the Tashkent City Court, partly modified by the appeal body of the same court on 13 April 2006, under several provisions of the Criminal Code.
وأشارت الدولة الطرف إلى أن زوج صاحبة البلاغ قد حُكم عليه بالسجن لمدة 10 سنوات و6 أشهر وحُظرت عليه ممارسة أية أنشطة اقتصادية لمدة خمس سنوات، بموجب قرار محكمة مدينة طشقند الذي عدّله جزئياً حكم هيئة الاستئناف بالمحكمة نفسها في 13 نيسان/أبريل 2006، استناداً إلى العديد من أحكام القانون الجنائي.

In its view, these proceedings concluded that the author's husband did lose the ownership right to the property in question after having emigrated, the ownership having passed to the State, and that after 1989 the author's husband had the possibility of seeking restitution of the property solely through restitution proceedings and not through a declaratory action under the Civil Code.
وترى الدولة الطرف أن هذه الإجراءات توصلت إلى أن زوج صاحبة البلاغ قد فقد حقه في ملكية البناية المذكورة، بعد أن هاجر، وأن الملكية انتقلت إلى الدولة، وأنه بعد عام 1989 كانت أمام زوج صاحبة البلاغ فرصة لتقديم طلب لاسترداد الملكية وذلك من خلال إجراءات استرداد الملكية وليس من خلال رفع دعوى إيضاحية في إطار القانون المدني.
