16- تُبيّن التجربة أن حالات الاختفاء القسري لا تحدث غالباً في إطار هجوم واسع النطاق أو منهجي ضد المدنيين.

1. For the purpose of this Statute, " crime against humanity " means any of the following acts when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack:
1 - لغرض هذا النظام الأساسي، يشكل أي فعل من الأفعال التالية " جريمة ضد الإنسانية " متى ارتكب في إطار هجوم واسع النطاق أو منهجي موجه ضد أية مجموعة من السكان المدنيين، وعن علم بالهجوم:

Under article 7 of the Rome Statute, torture is one of the acts constituting a “crime against humanity” when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack.
فالتعذيب، بموجب المادة ٧ من نظام روما اﻷساسي، فعل من اﻷفعال التي تشكل " جريمة ضد البشرية " متى ارتكب في إطار هجوم واسع النطاق أو منهجي موجﱠه ضد أي مجموعة من السكان المدنيين، وعن علم بالهجوم.

27. A crime against humanity comprises acts of murder, extermination, persecution and similar other inhumane acts committed as part of a widespread or systematic attack directed against any civilian population with knowledge of the attack.
27 - تشمل الجريمة ضد الإنسانية أعمال القتل، والإبادة والاضطهاد وغيرها من الأفعال غير الإنسانية التي ترتكب في إطار هجوم واسع النطاق أو منهجي موجه ضد أي مجموعة من السكان المدنيين وعن علم بالهجوم.

" 1. For the purposes of this Act, `crimes against humanity'means any of the following acts when knowingly committed as part of a widespread or systematic attack directed against any civilian population:
" أولاً- الجرائم ضد الإنسانية تعني لأغراض هذا القانون أياً من الأفعال المدرجة في أدناه متى ارتكبت في إطار هجوم واسع النطاق أو منهجي موجّه ضد أية مجموعة من السكان المدنيين وعن علم بهذا الهجوم:

The ICC has jurisdiction over such crimes “when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack” (art. 7 (1)).
وتختص المحكمة بالنظر في هذه الجرائم " متى ارتكبت في إطار هجوم واسع النطاق أو منهجي موجﱠه ضد أية مجموعة من السكان المدنيين، وعن علم بالهجوم " )المادة ٧ )١((.

Article 7 of the Statute defines a crime against humanity as an act committed as part of a " widespread or systematic attack against any civilian population, with knowledge of the attack " .
فالمادة 7 من هذا النظام الأساسي تعرّف الجريمة المرتكبة ضد الإنسانية بأنها فعل ارتُكب في إطار " هجوم واسع النطاق أو منهجي موجه ضد أي مجموعة من السكان المدنيين، وعن علم بالهجوم " (33).

Rape, sexual slavery, enforced prostitution, and forced pregnancy may constitute crimes against humanity " when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack " .
ويمكن أن يشكل الاغتصاب والاستعباد الجنسي والبغاء القسري والحمل القسري جرائم ضد الإنسانية " متى ارتكبت في إطار هجوم واسع النطاق أو منهجي موجه ضد أي مجموعة من السكان المدنيين، وعن علم بالهجوم " (1).

International law recognizes detention or other severe deprivation of physical liberty as a crime against humanity, where it is committed as part of a widespread or systematic attack against any civilian population.
ويعتبر القانون الدولي الاحتجاز أو الحرمان الشديد على أي نحو آخر من الحرية البدنية جريمة ضد الإنسانية، متى ارتكب في إطار هجوم واسع النطاق أو منهجي موجه ضد أية مجموعة من السكان المدنيين().

Article 7 (1) (d) provides that " [d]eportation or forcible transfer of the population " when committed as " part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack " , constitutes a crime against humanity.
إذ تنص المادة 7 (1) (د) على أن " إبعاد السكان أو النقل القسري للسكان " متى ارتُكب " في إطار هجوم واسع النطاق أو منهجي موجه ضد أية مجموعة من السكان المدنيين، وعن علم بالهجوم " يشكل جريمة ضد الإنسانية.

This definition includes several criteria: " For the purposes of this present Statute `crimes against humanity'means [any of the following] acts where committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack. "
ويشمل هذا التعريف عدة معايير: " لغرض هذا النظام الأساسي، يشكل أي فعل من الأفعال التالية جريمة ضد الإنسانية متى ارتكب في إطار هجوم واسع النطاق أو منهجي موجه ضد أية مجموعة من السكان المدنيين وعن علم بالهجوم " .

28. A crime against humanity has been committed when one of the acts listed in article 7 of the Rome Statute is committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack.
28 - وتنطبق الجريمة ضد الإنسانية إذا ارتُكب أحد الأفعال المذكورة في المادة 7 من نظام روما الأساسي() في إطار هجوم واسع النطاق أو منهجي موجه ضد أي مجموعة من السكان المدنيين وعن علم بهذا الهجوم.

101. According to article 7 of the Rome Statute of the International Criminal Court, " crimes against humanity " include acts such as murder, torture and unlawful imprisonment when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack.
101- وفقاً للمادة 7 من نظام روما الأساسي للمحكمة الجنائية الدولية، تشمل " الجرائم ضد الإنسانية " أفعالاً من قبيل القتل العمد والتعذيب والسجن غير القانوني، متى ارتُكبت في إطار هجوم واسع النطاق أو منهجي موجه ضد أية مجموعة من السكان المدنيين، وعن علم بالهجوم.

Other States, however, have a single offence in their domestic law, which is sufficiently broad to include any instance of this crime, be it committed as an isolated act or as part of a widespread or systematic attack against a civilian population.

(b) Codification of an autonomous offence of enforced disappearance sufficiently broad to cover enforced disappearances committed as part of a widespread or systematic attack against a civilian population, but also isolated acts;

11. These same elements are repeated in article 7 (1) of the Statute of the International Criminal Court which states: " For the purpose of this Statute, `crime against humanity'means any of the following acts when committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack. "

Article 7, paragraph 1 (d) of the Rome Statute for the International Criminal Court considers " deportation or forcible transfer of population " as a crime against humanity when it is committed " as part of a widespread or systematic attack against any civilian population, with knowledge of the attack. "
