In article 3, paragraph 3, the Drafting Committee should note that the term “special agreement” was understood to mean an agreement between the Court and the State concerned.

2. Such changes shall take effect in respect of requests for cooperation made by the Court at a time agreed between the Court and the State or, in the absence of such an agreement, 45 days after the Court has received the communication and, in all cases, without prejudice to current requests or requests in progress.
2 - تسري هذه التغييرات على طلبات التعاون التي تقدمها المحكمة في الوقت المتفق عليه بين المحكمة والدولة أو، في حال عدم وجود مثل هذا الاتفاق، بعد 45 يوما من تلقي المحكمة للإخطار وفي جميع الأحوال دون المساس بالطلبات الحالية أو الطلبات الجاري النظر فيها.
