Sections VIII and IX of the Criminal Code of Turkmenistan establish criminal liability for crimes against the Peace and Security of mankind, as well as crimes against the State.

However, his delegation still had doubts about including treaty-based crimes at the present stage, although it believed that the draft Code of Crimes against the Peace and Security of Mankind should be linked to the court.

29. On the competence ratione materiae of the court, only those offences that incontestably constituted crimes against the Peace and Security of mankind should fall within its jurisdiction.
٢٩ - وفيما يتعلق بالاختصاص الموضوعي للمحكمة قال إنه ينبغي ألا يقع ضمن اختصاصها سوى الجرائم التي تشكل بلا نزاع جرائم ضد سلم اﻹنسانية وأمنها.

The draft Code of Crimes against the Peace and Security of Mankind should be taken into account in defining the core crimes. Penalties should be severe enough to have a deterrent value and even include the death penalty in certain cases.
كما ينبغي مراعاة مشروع المادة المتعلقة بالجرائم المرتكبة ضد سلم اﻹنسانية وأمنها عند تعريف الجرائم الرئيسية، على أن تكون العقوبة قاسية بدرجة كافية حتى يكون لها أثر رادع إلى حد أن تشمل عقوبة اﻹعدام في بعض الحالات.

The work of the International Law Commission on the establishment of an international criminal court and the drafting of a code of crimes against the Peace and Security of mankind would also contribute to the effective punishment of terrorism.

30. The statute must refer explicitly to the draft Code of Crimes against the Peace and Security of Mankind, and the two texts must be mutually compatible.
٣٠ - وأكد على ضرورة أن يشير النظام اﻷساسي صراحة إلى مشروع قانون الجرائم المرتكبة ضد سلم اﻹنسانية وأمنها كما يجب أن يكون هناك اتساق بين النصين.
