Commenting on the relevance of the CISG, the Tribunal noted that the Convention embodies universal principles applicable to international contracts and that both parties were located in countries that were parties to the CISG.
ولاحظت هيئة التحكيم، لدى تعليقها على أهمية اتفاقية البيع، أنَّ الاتفاقية تجسّد المبادئ العالمية التي تنطبق على العقود الدولية وأن كلا الطرفين كان موجوداً في بلد طرف في اتفاقية البيع.

16- تنطبق الاتفاقية على العقود الدولية بصرف النظر عن طبيعتها وتكييفها بموجب القانون الداخلي.

It was noted that the United Nations Sales Convention only applied to international contracts if both parties were located in contracting States of the Convention.
37- أشير إلى أن اتفاقية الأمم المتحدة للبيع لا تنطبق على العقود الدولية الا اذا كان مكان الطرفين كليهما موجودا في دولتين متعاقدتين في الاتفاقية.

It was pointed out that the draft paragraph followed a similar rule contained in article 1, paragraph 2, of the United Nations Sales Convention, which applied to international contracts if both parties were located in Contracting States of the Convention, but not when such a situation was not apparent either from the contract or from the dealings between the parties.
45- أشير إلى أن مشروع الفقرة يتّبع قاعدة مماثلة واردة في الفقرة 2 من المادة 1 من اتفاقية الأمم المتحدة للبيع، وهي قاعدة تنطبق على العقود الدولية إذا كان الطرفان كلاهما موجودين في دولتين متعاقدتين بشأن الاتفاقية، لكنها لا تنطبق عندما لا تكون تلك الحالة ظاهرة من العقد أو من المعاملات بين الطرفين.

The application of the draft convention would be simplified and its practical reach greatly enhanced if it were simply to apply to international contracts, that is, contracts between parties in two different States, without the cumulative requirement that both those States should also be contracting States of the draft convention.

The Court of Cassation referred to articles 1 and 4 of the Vienna Convention and noted that, in accordance with those provisions, the Convention applied to international contracts for the sale of goods and governed only the rights and obligations of the seller and the buyer arising out of any such contract.

" 3. Any State may declare at any time that it will not apply this Convention [or any specific provision thereof] to international contracts falling within the scope of [any of the above conventions.] [one or more international agreements, treaties or conventions to which the State is a Contracting Party and which are identified in that State's declaration.]
" 3- يجوز لأي دولة أن تعلن في أي وقت أنّها لن تطبق هذه الاتفاقية [أو أي حكم معين من أحكامها] على العقود الدولية التي تندرج في نطاق [أي من الاتفاقيات المذكورة أعلاه.] [واحد أو أكثر من الاتفاقات أو المعاهدات أو الاتفاقيات الدولية التي تكون الدولة المعنية طرفا متعاقدا فيها وتحددها تلك الدولة في اعلانها.]

In support of the current formulation, it was noted that the United Nations Convention on Contracts for the International Sale of Goods (Vienna, 1980) ( " the United Nations Sales Convention " ) only applied to international contracts if both parties were located in contracting States of the Convention or the rules of private international law led to the application of the law of a Contracting State.
وتأييدا للصيغة الراهنة، لوحظ أن اتفاقية الأمم المتحدة بشأن عقود البيع الدولي للبضائع (فيينا، 1980) ( " اتفاقية الأمم المتحدة للبيع " ) لا تنطبق على العقود الدولية إلا إذا كان مكانا الطرفين في دولتين متعاقدتين في الاتفاقية أو كانت قواعد القانون الدولي الخاص تفضي إلى انطباق قانون دولة متعاقدة.

In addition, it was noted that the language that appeared in paragraph (1) within square brackets was based on article 7 of the Inter-American Convention on the Law Applicable to international contracts (Mexico City, 1994; hereinafter referred to as “the Inter-American Convention”) and article 3(1) of the Rome Convention.
وأشير اضافة الى ذلك الى أن العبارة الواردة بين قوسين معقوفتين في الفقرة )١( تستند الى المادة ٧ من اتفاقية البلدان اﻷمريكية بشأن القانون المنطبق على العقود الدولية )مكسيكو العاصمة ، سنة ٤٩٩١ ؛ ويشار اليها فيها يلي بـ " اتفاقية البلدان اﻷمريكية " ( والمادة ٣ )١( من اتفاقية روما .

The Secretariat participated as an observer in meetings of the HccH Working Group on Choice of Law in International Contracts (The Hague, The Netherlands, 24-26 June 2013 and 27-28 January 2014).
6- شاركت الأمانة بصفة مراقب في اجتماعات الفريق العامل المعني باختيار القانون المنطبق على العقود الدولية التابع لمؤتمر لاهاي (لاهاي، هولندا، 24-26 حزيران/يونيه 2013 و27-28 كانون الثاني/يناير 2014).
