This clause, which relates in general terms to the rules of international law applicable to the expulsion of aliens in the event of an armed conflict involving the expelling State aims to avoid any incompatibility between the rights and obligations of the State set out in the present draft articles and those under international humanitarian law.

Since the procedures applicable to the expulsion of aliens unlawfully present varied considerably from one State to another, the Special Rapporteur had been of the view that it was preferable to leave those procedures to be regulated by national legislation, without prejudice to a State's right to provide such aliens with the same guarantees as those for aliens lawfully present on its territory.
