It alleges that because Iran was not a member of the Allied Coalition Forces and had no choice but to prepare itself against the possible sudden expansion of the conflict into its territory, the costs of such preparations should be compensable.

The Panel has considered in particular the findings of the “B” and “D” Panels on analogous issues, arising in the context of Governing Council decision 11,[xxxiii] which decision operates so as to exclude compensation for losses of individuals who were members of the Allied Coalition Forces.[xxxiv] The “B” Panel stated that:

Moreover, at its eighty-first meeting on 30 September 1998, the Governing Council concluded that claims for military costs of States that were not members of the Allied Coalition Forces are not eligible for compensation by the Commission.

Claims by members of State forces that were not members of the Allied Coalition Forces were similarly not eligible for compensation for loss or injury arising as a consequence of their involvement in military operations against Iraq, except if the three conditions set out in paragraphs (a), (b) and (c) of Governing Council decision 11 were met.

In addition to providing " host nation support " , Saudi Arabia was a member of the Allied Coalition Forces and participated in military operations against Iraq. / Approximately 100,000 Saudi Arabian troops, including members of the Army, Air Force and National Guard, were mobilized and deployed during the period of Iraq's invasion and occupation of Kuwait.

23- ينص مقرر مجلس الإدارة 19 على أن " تكاليف قوات التحالف، بما في ذلك تكاليف عملياتها العسكرية ضد العراق، غير مؤهلة للتعويض " (19). وخلص مجلس الإدارة في جلسته الحادية والثمانين المعقودة في 30 أيلول/سبتمبر 1998، إلى أن المطالبات المتعلقة بالتكاليف العسكرية المقدمة من دول ليست أعضاء في قوات التحالف غير مؤهلة للتعويض من جانب اللجنة.

The Governing Council also decided at its 81st meeting that “claims for military costs of States that were not members of the Allied Coalition Forces are not eligible for compensation by the Commission”.[xxxii] In the light of this, the Panel now turns to consider whether the third instalment part two claims that seek compensation for the loss of, or damage to, military assets are compensable.

For its proceedings to be valid, the Sub-Committee shall require a quorum of at least one representative of the Republic of Iraq and representatives of at least three of the States party to the Coalition Forces.
