On 20 June 2003, the Government of Cyprus notified the Secretary-General of the withdrawal of its reservation to article 2, paragraph 1, of the Second Optional Protocol, pursuant to which the Republic of Cyprus reserved the right to apply the death penalty in times of war pursuant to a conviction of a most serious crime of a military nature committed during wartime.

أما البروتوكول الاختياري الثاني فينص في الفقرة ١ من المادة ٢ على أنه " لا يسمح بأي تحفظ على هذا البروتوكول إلا بالنسبة لتحفظ يكون قد أعلن عند التصديق عليه أو الانضمام إليه وينص على تطبيق عقوبة اﻹعدام في وقت الحرب طبقا ﻹدانة في جريمة بالغة الخطورة تكون ذات طبيعة عسكرية وترتكب في وقت الحرب " وتنص الفقرتان ٢ و٣ من هذه المادة على بعض الالتزامات اﻹجرائية.
